2 OUT OF 3
INT - HOUSE - NIGHT
Two men are in an apartment watching a football game. There is a bottle of vodka and beer cans on the table. TREVOR, one of the two men is about twenty-seven years old. He is about five foot ten and one hundred and seventy pounds. He has long hair pulled back in a ponytail. Both of his arms are covered with tattoos. There is also a tribal tattoo that starts on his arm and goes all the way up to his neck.
SMOKE is twenty-seven and about five feet six inches tall with a muscular build. He has short blonde hair with piecing blue eyes that are bloodshot. He looks like he is on drugs.
SMOKE
You’re not going to do it.
TREVOR
I am. It’s getting bad. We fight
all the time. It’s a serious
headache. Every other day. The
sex is awesome but that only goes
so far.
SMOKE
Who else is going to put up with all
your shit. You’re a quirky bastard
and you’re hard to get along with.
TREVOR
Me? Look at you. I’m a little
weird but you’re the biggest
head case I know.
SMOKE
That’s why I would not break up
with a piece of ass like that.
She’s hot. She tolerates you.
TREVOR
She was there for me after jail and
everything but dude she doesn't
even want to have kids. The age
bothers me a little bit.
SMOKE
Five years is nothing. She’s only
thirty-two. She could change her
mind.
TREVOR
It’s more than that. We are
so fuckin different.
SMOKE
Dude! You’re different from
everyone.
They both laugh.
TREVOR
I’m not happy anymore. Better to
break it off now then later.
SMOKE
Four years down the drain. If
you’re not happy then I guess
you gotta do what you gotta do.
I just hope that you don’t regret it.
Trevor gets up.
TREVOR
I’m doing it.
SMOKE
Good luck.
Trevor walks out the door.
INT. - CAR - NIGHT
Trevor is driving on the parkway going East. On the West side of the highway there are fire trucks and police directing traffic. In the middle of the highway is a dark car that has flipped over. On the right of way, there is a smashed truck.
TREVOR
That sucks.
Trevor continues driving East on the highway.
INT - APARTMENT - NIGHT
Trevor walks into his apartment. His face looks drained. He sits on the couch and puts his head back and closes his eyes. The clock reads 11:30. The phone awakens him. The clock reads 4:30. He picks up the phone.
TREVOR
Hello. Yeah I’ll be here.
Do I need my lawyer... OK.
Yeah I’ll be here.
Trevor takes the beer cans off the coffee table and throws them in the garbage.
INT - APARTMENT - NIGHT
There is a knock at the door. Trevor walks over to the door and opens it. Two men in suits are standing in the doorway. On is about forty-five and the other about fifty. They are both over six feet tall.
DET ROSS
I’m Detective Ross and this is
Detective Alves. Can we come in?
Trevor looks and the Detectives for a few seconds.
TREVOR
Depends. What do you want?
DET ROSS
We have some bad news.
TREVOR
Come in.
The Detectives enter.
DET ALVES
Please have a seat.
Trevor looks at Detective Alves. Trevor sits down on the couch.
DET ROSS
Your sister and her husband
were killed in a traffic accident
on the Southern State Parkway.
He puts his hands on his face. Trevor stands up.
TREVOR
No. No. No.
Trevor punches the wall causing a hole on it. He puts his head down. He quickly snaps his head up. The Detectives take a step back. Detective Ross puts his hand on gun that is in his waist.
TREVOR
Where are the kids?
DET ROSS
They are with the maid CeCe at
the house. They are fine.
Social Services already spoke
with the maid.
Trevor grabs his jacket and walks out the door. The Detectives follow. Trevor looks the door. Trevor runs down the hall.
DET ALVES
So that's the two out of three kid.
He doesn’t look like a killer.
Without the tats he looks like
an innocent kid.
DET ROSS
He isn’t that innocent.. But I do
feel bad for him.
EXT – HOUSE - NIGHT
Trevor pulls up to a beautiful house with a minivan in the driveway. It is a neat two story brick house. Trevor parks in the front and walks slowly towards the front entrance.
INT - HOUSE - NIGHT
Trevor walks in the door. A black woman, CECE, about thirty years old is sitting at the table crying. Her hair is pulled back with a bandana. She has a pair of sweatpants and a sweatshirt on with slippers.
TREVOR
(low voice)
Hey CeCe, where are they?
CeCe gets up crying and hugs Trevor. Trevor's eyes water up.
CECE
Social Services are coming over
first thing in the morning.
TREVOR
Am I supposed to tell them? What
did Social Services say?
CECE
They told me what happened and
said they will come to the house
in the morning.
TREVOR
I guess I’ll talk to the kids in
the morning. How do you tell
two children that their parents
are dead?
CeCe cries.
INT – FUNERAL - DAY
Trevor and CeCe are sitting at a front of room closest to the two caskets. In between then are TINA and SHELTON. Both are about five years old. They are both stone faced. The funeral parlor is packed with people as they walk up to the closed casket and pray.
INT - HOUSE - NIGHT
Trevor is sitting at the table. He is still dressed in a suit and there is an open bottle of vodka on the table. There is a knock at the door. Trevor gets up and answers the door. ROBERT, Shelton’s partner at the law firm is dressed in a suit with slicked back hair.
ROBERT
How you holding up?
TREVOR
I'll be alright. It’s the kids I’m
worried about. I know you guys
are defense lawyers but what’s going
happens with the kids?
ROBERT
I’ll be one of the lawyers representing
the kids but my law knowledge is
primarily as a defense attorney. I
can give you my opinion when it
comes to the children’s assets.
Shelton was obviously wealthy. He owns
half of our practice. And I know
he had a few million dollar insurance
policy in case of death.
TREVOR
How do you know that?
ROBERT
Because we both got it years ago
at the same time. And the house
is almost all paid for.
TREVOR
My sister told me that if anything
ever happened to her, that she
wanted me to take care of the kids.
ROBERT
To be honest, with your background,
I don’t think they will allow that.
TREVOR
What the fuck does that mean? I
was never convicted of anything.
I served my country! What else is
there? Who else is supposed to take
care of the kids?
ROBERT
Probably foster care.
TREVOR
Foster care. Are you serious? I’m
the only family these kids have.
I’m the only one that they have and now
I have to put then in some foster care
so they can be fucked for life. Robert,
they’re already fucked. Please do what
you can. Don’t let them go to foster care.
ROBERT
I’ll talk to the courts but I don’t
think there is much I can do.
TREVOR
Can’t you petition the courts to
allow to have me get custody.
ROBERT
You’re twenty seven with a controversial
background, and no steady job. You
have to be realistic. Maybe an adopted
family could be the best thing. A
normal environment with a couple who
can provide and console.
Trevor takes a gulp from the bottle of vodka.
INT - HOUSE - MORNING
Trevor is sitting at the same table in the same suit. The vodka bottle is empty. Tina and Shelton come down the stairs. They are both crying. Trevor tears up. Trevor hugs them both.
SHELTON
Please don’t leave us.
TREVOR
I’m not going anywhere.
SHELTON
Swear you will not leave.
TREVOR
I swear.
Shelton walks to the other room.
TINA
I know you will never leave us.
Tina pulls Trevor’s head down and rubs her nose against his. Then she walks in the other room. CeCe comes down the stairs with baby Alex. Alex is about six months old. Trevor looks out the window so CeCe can not see him crying.
INT - OFFICE - DAY
Trevor is sitting in a law office talking with Paul Marcelli, a lawyer for the family.
PAUL
OK, this is where we are at. You
have to attend a hearing at which
I will present your case. The state
will try to discredit you and
will suggest foster care.
TREVOR
How about this? What if I moved in
the house, and CeCe is like a nanny
who takes care of the kids during
the day when I’m working.
PAUL
The maid CeCe.
TREVOR
She is a live in nanny. She has
an apartment in the basement and
she basically took care of the
children when my sister and Shelton
were working.
PAUL
I doubt that they will allow that.
They are going to want a normal
stable household. They are going to
definitely question you about your
case and beside all that, you don’t
have a steady nine to five which
they want.
TREVOR
So realistically, there is no way
that they are going to let me have custody.
PAUL
Pretty much.
INT - HOUSE - DAY
Trevor is sitting on the couch as the kids are playing a video game. Shelton puts the control down and walks into the other room. Trevor follows. Shelton starts to cry.
SHELTON
(Crying))
I want my mom.
Trevor gets on his knees and hugs him. Shelton is crying hysterical.
SHELTON
Please don’t die.
CeCe see’s this and cries. Shelton goes back into the other room.
Trevor picks up his cell phone.
TREVOR
Kim. It’s me. Please pick up.
Call me when you get this.
INT - HOUSE - DAY
Trevor is in the kitchen making eggs. Baby Alex is in the high chair.
TREVOR
OK guys. Let’s eat.
Shelton and Tina come down the stairs. Tina runs up to Trevor and pulls him down and rubs her nose against his. The kids sit at the table.
TREVOR
How many eggs you want?
TINA
I want three and toast.
SHELTON
I don’t want any. I'm not hungry.
TREVOR
How about some toast and juice?
SHELTON
No. I'm not hungry.
Trevor puts some eggs on the plate for Tina.
TREVOR
The psychologist is coming to
the house at twelve, OK. She
is really nice and she wants
to talk to you guys. I’ll be
right in the next room if you
need me. She is really funny.
You guys will love her.
CeCe walks into the kitchen.
CECE
Hey guys.
TINA
Hi CeCe.
Shelton
Hi.
CECE
I would have made breakfast.
Trevor
It’s OK. I was up. I have
to run to the store. I’ll be
back in a half hour. Could you
just watch them?
CECE
Sure. No problem.
TREVOR
OK guys, I’ll be right back
Tina gets up and rubs noses with Trevor. Trevor walks out the door.
INT - APARTMENT - DAY
Trevor knocks on the door. A blonde woman, KIM, of about thirty comes to the door.
KIM
Trevor what are you doing? You
can’t just come over here.
TREVOR
I wanted to see you. You don’t pick
up your phone. You don’t return my
texts. What the hell!
KIM
Trevor, it’s over, we are done.
TREVOR
Listen I know I wasn’t the best
boyfriend, but I need you. I have
this whole situation to deal with.
I need you. I miss you. Kim, I
love you.
KIM
Trevor, no. I don’t feel the same way.
TREVOR
Can I come in?
KIM
No!
TREVOR
What? Do you have a boyfriend now?
What the hell is wrong with you?
My world is in a twister right now
and you don’t even care. What the
fuck.
KIM
Just leave. OK.
TREVOR
Do you have any idea what I’m going
through?
KIM
I don’t care. That has nothing to
do with me.
TREVOR
You could move in. We could be
together, and raise those kids.
I know you didn’t want to have
any kids because of pregnancy
but now you can have three
without going through childbirth.
We could be a family.
KIM
We’re done. We are not getting back
together. It’s over. How many
times do I have to tell you?
Trevor’s face looks sad.
KIM
You should leave.
Kim goes in and closes the door.
EXT - TRACK - DAY
Trevor is running on the track as Tina and Shelton are racing him on their bikes. In the stands watching is CeCe and baby Alex. Tina and Shelton are trying to catch Trevor.
INT. – HOUSE - MORNING
Trevor is waiting at the school bus stop with Shelton and Tina. The school bus pulls up and the doors open. Shelton runs on the bus. Tina runs up on the bus. Then she runs back down to Trevor and rubs her nose against his.
TINA
Noses.
She runs back on the bus. The bus leaves. Trevor turns around and sobs uncontrollably.
INT – HOUSE - DAY
CeCe is feeding baby Alex as Trevor sits down.
TREVOR
My head is like a fucking
windmill. In my twenty-seven
years you know how many times
I cried? Never. Now I cry everyday.
Trevor walks to the cabinet and takes out a bottle of Jack Daniels. He pours some in a cup and gulps it down. He then puts the bottle back.
CECE
Are you going to be OK?
TREVOR
I have to be. I have no choice.
I’m so confused. Kim doesn’t
want to get back with me. I
told her she could move in
and we could get married. It
would be great for the kids.
CeCe looks down at the floor. Trevor doesn’t notice.
TREVOR
Kim is so stubborn. I don’t know.
CECE
Maybe you guys aren’t meant to be.
Some people just are not meant to be.
TREVOR
She’s the one for me. I love her.
I want to be with her. It would be
so perfect, we could raise the kids.
They would have a normal life.
Trevor holds back his tears. He gets up and walks to the other room. CeCe looks sad. She picks up the baby and holds him.
INT - ATTORNEY OFFICE - DAY
Trevor is sitting in a chair in from of the desk. Paul walks in the office.
PAUL
Sorry. Late client. Alright
here’s the situation. I already
petitioned the court about you
getting custody, so we go present
our case and see what happens.
TREVOR
How does it look?
PAUL
Not good. With your background.
TREVOR
I fuckin know, probably foster care.
PAUL
Just prepare yourself for the worst.
INT - BAR - NIGHT
Trevor is at the bar drinking. Two men come up to him.
MAN
I don’t mean to bother you but
we’re from California, and I was
just wondering are the two out of
three guy?
Trevor looks at the two men with a glazed look.
MAN
I knew it was you. Let me buy
you a drink. What are you drinking.
Trevor doesn’t answer.
MAN
Bartender, give this guy anything
he wants! On me.
TREVOR
Thanks.
MAN
Could we get a picture?
The bartender comes over.
Bartender.
Maybe later guys, Not a good time.
MAN
OK. Anything you want kid. On
the house.
Smoke is wearing a leather jacket and a leather hat. He walks toward
Trevor.
SMOKE
I’ll take that drink.
Trevor smiles and looks up. He puts his hands on his face and then smiles. He gets off the stool. As Trevor goes to hug him Smoke lifts Trevor over his head causing a scene in the bar. Smoke lets him down and they both laugh.
TREVOR
When the fuck did you get out?
SMOKE
About four hours ago. I heard
what happened man. How you
holding up?
TREVOR
OK, I guess. The hearing is in
two days. Forget about that.
What’s up with you? You going to
stay out this time?
SMOKE
I see you still have people
buying you drinks. Some
things never change.
TREVOR
Look whose talking. Let me buy
you a drink. Mike bring the
wild turkey.
Mike the bartender starts to pour.
TREVOR
Just leave the bottle.
SMOKE
Yeah. It’s on those guys.
Let’s see what you got.
Trevor fills the shot glasses. They both down those. He pours another, both go down. Trevor pours a third, both go down. Another, both go down. Another, both go down.
TREVOR
I got all night.
Trevor pours another, he downs his. Smokes drinks his and falls to the side. They both laugh.
SMOKE
It’s good to be home.
Smoke grabs him and they both wrestle laughing.
INT - HOUSE - NIGHT
Trevor stumbles in the house and collapses on the couch. CeCe comes up from the basement and see’s him lying there. She stares at him for a minute. She walks to the closet and puts a blanket on him and kisses him on the lips. Then she goes back down stairs. From the stairs, Tina see’s everything and is covering her mouth not to laugh.
INT - COURT ROOM - DAY
Trevor is sitting at a table with his lawyer, Paul. Tina and Shelton are sitting next to Trevor. CeCe and a few other spectators are sitting in the row. A mediator/counselor enters the room and takes their seat.
MEDIATOR
We all know why we are here.
Counselor Shay would you
like to start?
PAUL
No. Ms. Petite can start.
MS. PETIT
Okay. Well your honor, as we all
know, Tina and Shelton Imeroni have
been through a lot of anguish and
pain. There is no better place for
them then a good foster home where
they can have a chance at a good
life and afforded all the luxuries
of normal everyday children. Mr...
O’Brien is simply unfit to raise
three young children.
PAUL
Your honor, what is this being
based on? He is the biological
uncle. He served our country
in the Marines and has a two
year college degree. It was the
wishes of Mrs. Imeroni that if
anything should happen to her
or her husband that he be the
one to take care of the children.
MS. PETIT
There is no documented proof of that
and even if there is, he is unfit to
care for children. Mr. O’Brien has
openly admitted to murdering three people.
PAUL
Mr. O'Brien was never convicted
of killing anybody. He
defended himself and saved
the life of an innocent victim.
MS. PETIT
Mr. O'Brien spent eleven months
in jail. He is not a suitable
replacement for the raising of
these children.
PAUL
Again, he was never convicted
of a crime and was unjustly
held in prison for eleven months.
He was acquitted by a jury of
his peers. Mr. O'Brien has a
clean record just like you or I.
In addition he showed great
courage by risking his life to
save the life of a victim.
MS. PETIT
Alleged victim. Your honor
it is in the best interest
of the children if they are
in foster care.
PAUL
These children have a bond
with their uncle and have
suffered enough They belong
in their own house with family.
MS. PETIT
Mr. O’Brien is clearly unfit.
He doesn’t hold a full time
job. He is unable to support
three small children.
PAUL
Mr. O’Brien has never been
convicted of a crime, honorable
served his country and is the
only family these children have.
They have suffered enough. In
addition, Mr. O’Brien does work
and is due to get full time soon.
MS. PETIT
Your honor would you have Mr.
O'Brien roll up his sleeves.
PAUL
What is this a strip show?
Your honor, there is no
reason for Mr. O'Brien to
lift up his sleeves. This
is crazy.
JUDGE
Mr. O’Brien, your sleeves.
Trevor rolls up his sleeves revealing that his arms are covered on tattoos.
PAUL
What does tattoos have to do
with anything? That is
called art, your honor. It
is very popular with all
members of society in this
day and age.
JUDGE
I have all the documents and
all the information to
render a decision. We
will reconvene in three weeks.
The judge gets up and walks out the side door. Trevor has an angry look on his face. He gets up with Paul and walk toward the door.
INT - OFFICE - DAY
Trevor and Paul are in the office.
TREVOR
We’re going to lose. You can
tell. That judge allowed my
sleeves to be rolled up. They
already made up their minds.
What a fucking joke.
PAUL
Who knows. You never know.
INT - HOUSE – DAY
Trevor, Tina, and Shelton are sitting at the kitchen table as Trevor is cooking the dinner.
TREVOR
Anything exciting at school?
TINA
Well I had a good day, did all
my work, and had fun.
TREVOR
What about you Shelton, how was school?
SHELTON
Good.
TREVOR
Anything exciting?
SHELTON
No. Not really. I had fun at gym.
We played basketball.
TREVOR
Cool. Nice.
Trevor takes the food out of the oven.
TREVOR
All right. Chicken nuggets and
French fries.
SHELTON
Yes! I love French fries.
TINA
Me too.
TREVOR
Me three.
TINA
You’re funny Uncle Trevor.
Trevor makes two plates and gives them the food. He then spoon feeds baby Alex.
TREVOR
After dinner, we go to Carvel
for some ice cream.
SHELTON
Yes. I love ice cream.
TINA
If we go to a foster home, can
you come and live with us?
SHELTON
Of course he can.
TREVOR
Well. We will see. Hopefully
you can stay here, but if you
have to go to a foster home,
then it might be fun there.
I heard a lot of good things
about foster homes. The people
are very nice and it’s like
having nice people take care
of you.
SHELTON
It’s not as nice as my house.
TREVOR
Well it can be.
TINA
It’s no way near as nice. I’ve
heard horror stories.
Trevor looks up surprised. He quickly puts a smile on his face.
TREVOR
Are you being crazy with me?
That's it.
Trevor picks Tina over his head. Tina starts laughing and screaming.
TREVOR
Are you being crazy with me?
TINA
No! No!
Shelton takes some of Tina’s French fries. Trevor puts her back in her seat.
SHELTON
You’re strong Uncle Trevor.
TREVOR
Let’s not think about anything
but French fries and Carvel ice cream.
SHELTON
I can’t wait. I want a vanilla swirl.
EXT - PORCH - Night
Trevor is sitting on the porch drinking a beer. CeCe come out of the house and starts cleaning up the porch. She has a summer dress on with her hair pulled back with a bandana.
TREVOR
Sit and relax. You don't have to
work twenty-four hours a day.
You’re off the clock. Have a seat.
Here have a beer. Smoke a joint.
CECE
I want you to know I think
what you are doing is very
admirable. I think everything
is going to work out.
TREVOR
It’s not. The reality is the
courts are not going to give
me custody. I have too much
baggage. It’s not going to happen.
CECE
How do you know? Maybe they will
see that you’re a good person
and let you have the children.
TREVOR
Am I a good person? I’m not exactly
humanitarian of the Year. I
have a past that is the reason
why they won’t give me custody.
The thing that pisses me off is
that I know I could raise those kids.
I definitely could.
CECE
I know you could.
TREVOR
I’ll get a job and pay you like
my sister did. I mean if you
wanted to. You could be the
live in nanny. I think I could
handle it and do a good job.
CECE
I think you would do a
wonderful job.
TREVOR
The house is already paid
for and all I would have to
do is pay the taxes and your
salary and all the small bills.
They’re going to hold my past
against me which makes no sense.
One has nothing to do with
the other.
CECE
We all have a past.
Trevor laughs.
TREVOR
Not like mine.
CECE
You would be surprised. I
know a little about your
situation just from what I read.
TREVOR
Maybe one day when I’m drunk, I’ll
tell you my situation. So what’s
your past? What did you do, come
to work late once.
CECE
If you only knew.
TREVOR
Well, I'm sure it wasn’t that
bad. You seem like a nice woman.
How was it working for my
sister and Shelton?
CECE
They were great. They treated me
good. She really loved you.
She talked about you a lot.
TREVOR
Anything good.
CECE
Yeah. Lots of times.
TREVOR
Did she ever bring up my past?
CECE
Only once in a while when she was
a little tipsy. She would talk
about you and your family.
TREVOR
I bet that was a wild conversation.
Anyway, what’s your situation?
Where are you from?
CECE
South Carolina.
TREVOR
No shit. I love Carolina. That’s
great. Why did you move here?
CECE
Long story. I told you we all have
a past.
TREVOR
How old are you?
CECE
Older than you.
TREVOR
I’m almost twenty-eight and you
don’t look older than me.
CECE
I’m thirty.
TREVOR
That’s close. You ever married?
Any kids?
CECE
No. Never married. No kids. I
actually can’t have kids.
TREVOR
Oh really. Why?
CECE
It’s a long story. Maybe I’ll
tell you when I’m drunk one day.
TREVOR
You don’t strike me as a drinker.
CECE
Maybe when I’m tipsy.
TREVOR
Ok. I’ll hold you to it.
CECE
Good.
EXT - WORK - DAY
Trevor is pushing bricks in a wheel barrel. He puts the wheel barrel down and walks over to his boss, JAY.
TREVOR
Hey Jay. I need to ask you
something.
JAY
Sure. What’s up?
TREVOR
Is there any way that you
could put me on the books
for more hours?
JAY
I wish I could but twenty is
the best I could do. I thought
you wanted to be half on and half
off the books. They are laying
people off everyday.
TREVOR
I did but now with the custody
thing I have to show that I’m
working full time.
JAY
I’m sorry but I can’t. You’re
not union so twenty hours is
the most I can give you on the
books. Just tell them you work
forty hours but only get paid
on the books for twenty.
TREVOR
I think that it’s illegal to
work off the books. I don’t
want to mention it to the
court cause then they could
us it against me.
JAY
Let me see what I can do. I’ll
ask around and see if there is
other work with other companies
that could put you on their books
for another twenty hours.
TREVOR
OK. Cool. Thanks.
JAY
I’m really sorry about what
happened to your sister.
TREVOR
Thanks.
EXT - BUS STOP - DAY
Shelton runs off the bus and gives Trevor a high five. Tina comes running of the bus and jumps into Trevor’s arms.
TREVOR
Friday night. Movie and popcorn
night. And snack night
TINA
And soda night.
SHELTON
And potato chip night.
TINA
And stay up late night.
SHELTON
And ice cream night.
TINA
And animal cracker night.
And wrestling night.
TREVOR
All right. All right. I get
the picture. Last one to the
house is a rotten egg.
The kids run toward the house.
INT - BAR - NIGHT
Trevor and Smoke are at the bar drinking.
TREVOR
So what are you going to do with yourself?
SMOKE
Same old shit. Hang out. Relax.
Do something stupid and go back to
jail.
Trevor laughs.
TREVOR
Don’t you get tired of that place?
SMOKE
To be honest, it’s not that bad.
I have a good time there. It’s
like a big fucking hangout. No
fucking girls but beside that,
it’s OK. What's going on with
the custody thing?
TREVOR
Not looking good. I go back in
a few weeks and then they make
a decision. For once I could
do something good that could
maybe make up for my past. It’s
fucked up. These kids love me.
They know nothing about my past.
All they care is that I’m there
Uncle. Maybe God is punishing me
for what I did.
SMOKE
What you did! You did nothing
wrong. They got what they deserved.
Come on, you think you were wrong
for what you did? You were never
so right.
TREVOR
I know but... I don’t know.
SMOKE
You did the right thing and
I’ll never forget it.
There is a ten second pause.
SMOKE
What’s up with the ex?
TREVOR
Another nightmare. I should
have never broke up with her.
It’s driving me crazy. I want
her so bad. I can’t get her
out of my dreams. I really
screwed that one up.
SMOKE
Call her.
TREVOR
Dude I tried. I call, write, e-mails,
and go by the house. She wants
nothing to do with me.
SMOKE
What a bitch.
TREVOR
This is the most trying time
of my like and she won’t even
talk to me. What kind of woman
does that? If the roles were
reversed I would be by her side.
She’s driving me crazy.
Smoke motions to the bartender.
SMOKET
Two more shots.
The bartender pours the shots and hands them to Smoke and Trevor.
SMOKE
Here. To numbing your pain.
TREVOR
Yeah. That’s all I do.
They both drink the shots.
TREVOR
You think God will ever
forgive us?
SMOKE
I don’t know what you’re talking about.
TREVOR
Yeah. Me neither.
They both smile.
INT - PSYCHOLOGIST OFFICE - NIGHT
Trevor is sitting talking to the DR. The door is open and Shelton and Tina are outside the door playing.
DR.
So how are you holding up?
TREVOR
OK, I guess. Trying to you
know, hold it together. I
just think that they are not
going to let me have custody.
My head is in a tailspin right
now. I recently broke up with
my girlfriend who now want nothing
to do with me. If it wasn’t for
the kids, I would have... I can’t
say what I would have done. Let
me ask you something. If a person,
I’m not saying me believe me, but
what’s the deal if a patient tells
you they want to kill themselves.
Again, it’s not me. I’m just
saying, if a patient tells you that.
DR.
For instance a police officer, they
have access to guns and can easily
take their own life. So then I
would have to report it for
their own good. But if a regular
person has thoughts of it, then
I don’t have to report it unless
they say something like I’m going
to kill my wife and children.
TREVOR
OK. So it’s OK to talk about it
but not to talk about it to
they point where the person
is saying they are going to do it.
DR.
Exactly.
TREVOR
Luckily I’m not a cop. Just kidding.
DR.
Why don’t you come in, see me and we
can talk.
TREVOR
OK. I’ll look into that. Thanks.
INT – HOUSE - DAY
Trevor is getting dressed. He is putting on a black suit. CeCe comes into the room. She is wearing a black dress with her hair pulled back.
TREVOR
What are you all dressed up for?
CECE
Well I would like to go with you
if you don't mind.
Trevor looks puzzled.
TREVOR
Sure OK.
INT - LIVING ROOM - DAY
The children are sitting on the couch watching television.
TINA
I know you’re going to win.
SHELTON
Yeah. You’re going to win Uncle
Trevor looks at the children sitting on the couch. On the love seat is MS. Walton, a seventy year old neighbor.
CECE
OK. Be good for Ms. Walton.
Trevor and CeCe walk toward the door. Tina comes running over to them at the door.
TINA
Don’t worry uncle. You’re going to win.
Tina pulls on Trevor’s collar and Trevor kneels down. Tina rubs her nose against his.
TINA
Noses. CeCe. Take care of him.
Trevor and CeCe look at each other puzzled.
INT. - CAR - DAY
Trevor and CeCe are driving.
TREVOR
I have a bad feeling about today.
CECE
I think you have a good chance.
TREVOR
I don’t think so.
CeCe puts her hand on Trevor’s.
CECE
You’re going to do fine.
INT - COURT ROOM - DAY
CeCe is sitting at the back of the court room. Trevor’s lawyer, Paul, is talking in front of a Judge. Below the judge is a panel of five people. There are three men and two women in business attire. Paul is talking to the panel. Another woman then gets up and addresses the panel. Afterward Trevor gets up and is addressed by the woman. He responds his answers to the panel. The woman says something to the judge. The judge then responds to Trevor. Trevor rolls up his sleeves with an angry look.
Trevor is sitting with his head down as his lawyer and the female are arguing. The judge hits his gravel.
Trevor and his lawyer are all standing as the judge addresses them. The judge looks at Trevor and speaks to him. Trevor puts his head down. CeCe takes a tissue out and dries her eyes.
INT - HALLWAY - DAY
Trevor and Paul are walking toward the elevator.
PAUL
OK. Well the next step is,
we will start the appeal process.
TREVOR
Yeah but in the meantime they
have to go to foster care! Right?
This is such fucking horseshit.
The elevator opens up. Trevor and CeCe walk in. The door closes.
EXT - STREET - DAY
Trevor and CeCe are standing in front of the building. Next to them is an NYPD recruiting table with two police officers sitting at a table.
CECE
I’m so sorry.
TREVOR
Now I get to tell two kids
that after their parents are
dead and their only Uncle is
unfit to care for them. Just
go without me. I need to be
alone. Take the car.
CECE
Are you sure?
TREVOR
Yeah. Just go. I need to think.
CeCe goes to hug Trevor but he turns away. CeCe walks away.
Trevor stands silent and frozen. He wipes his eyes and starts to walk past the NYPD recruiting table.
OFFICER
Hello sir. NYPD is hiring.
Good pay, benefits, retirement
after twenty years. Respectable job.
Trevor stops and looks at the officer. Trevor and the officer are locked in a stare.
OFFICER
Holy shit, your Mr.. Two
out of three. Right.
Trevor looks at the officer
TREVOR
Yeah.
OFFICER
Here. Take this application. We
need guys like you. As long
as you were never convicted
of a Felony.
The officer hands him the application.
EXT. - CAR - DAY
Trevor is driving a black truck with CeCe in the passenger seat. In the back seat is Tina and Shelton. In the middle is the baby. CeCe looks at Trevor. Trevor looks out the window. The children in the back seat are silent as they look out the windows. The car pulls up to a big house. On the porch is a couple, MR. and MRS. FOSTER and a woman in a suit, MRS. Taylor.. Trevor pulls the truck to the curb.
EXT - STREET - DAY
Trevor and CeCe get out of the car. Mr. and Mrs. Foster walk toward the truck.
MRS. TAYLOR
Hello Mr. O’Brien.
TREVOR
Hello.
Mrs. Taylor looks in the car window.
MRS. TAYLOR
Hi Tina. Hi Shelton. I have
something to show you.
The children look away.
TREVOR
It’s been like this all morning.
Mr. Foster puts out his hand and shakes Trevor. Mrs. Foster walks to the car.
MRS. FOSTER
I have a surprise for you in the
backyard.
Tina starts to cry. Trevor walks to the car and opens the door. Tina cries hysterically
TINA
Uncle, Uncle, I don’t want to go.
Trevor looks at her.
TINA
Please Uncle. Please no.
Trevor looks away.
TREVOR
I can’t do this.
CeCe walks to Tina and picks her up. Tina hugs CeCe. Mr. and Mrs. Foster walk toward the house followed by Mrs. Taylor. Tina wiggles out of CeCe arms violently. Trevor shakes his head as he tries to hold back his tears. Trevor then walks to the truck.
TREVOR
Shelton. Please come on. You
have to go.
Shelton exits the truck and starts to cry. Trevor rubs his eyes.
TREVOR
I’m sorry buddy. It’s only
going to be for a short time. I’m
going to be able to get you back
home soon. OK.
Shelton is crying as he walks toward the house. Tina is wailing out of CeCe’s arms. Trevor comes over and squats down so they are face to face. She puts her tiny hands on Trevor’s face.
TINA
Please Uncle. I’ll never do
anything wrong. I’ll be a
good forever.
CeCe breaks down and starts crying.
TINA
I want to live with you Uncle.
I love you.
Trevor is frozen. Trevor stares at her as tears roll down her eyes.
TREVOR
Mrs. Taylor. Take her.
Trevor gets up. CeCe who has Shelton by the hand takes Tina by the hand. They walk toward the house. Trevor stays behind as they walk toward the house. As they step on the porch Trevor runs to the porch. He picks Shelton up and looks him in the face.
TREVOR
I love you and I’ll get you
back home soon.
Shelton puts a mean face on and wiggles free from Trevor. CeCe takes Shelton’s hand and walks him in the house. Trevor picks Tina up.
TREVOR
I want you to know that I love
you. I will get you home soon.
OK.
TINA
(CRYING)
I want to go home now. Why
can’t we?
TREVOR
It’s only for a short time. OK.
TINA
You promise?
TREVOR
I promise. You’re my heart.
I can’t live without my heart.
You’re the love of my life.
Tina hugs Trevor.
TINA
I believe you Uncle.
Tina walks toward CeCe who is halfway in the door. Tina runs back toward Trevor.
TINA
Noses.
Tina rubs her nose against his and then runs back toward CeCe. Trevor turns and walks back toward the truck with tears running down his eyes.
INT - BAR - NIGHT
Trevor is sitting at the bar by himself. Smoke walks up to him and sits down.
SMOKE
I heard what happened. Sorry
dude.
The bartender walks to them.
SMOKE
Couple shots here. Is there
anything that can be done to
get them back? There has to
be some loophole.
TREVOR
I can appeal but on what grounds?
I’ve been trying to get a full
time job on the books but the only
skill I have is construction and
they’re all hurting. I can’t get
a job at like Home Depot because
that's not enough money to
justify me raising three
kids, even though they get
SSI money from the State.
SMOKE
So where does the state money go?
TREVOR
It goes to the Fosters. The
foster parents. It’s like
fifteen hundred a month.
SMOKE
With fifteen hundred and your
part time construction you
could definitely support them.
TREVOR
I know but it’s not just that,
it’s the whole two out of three thing. And a bunch of other shit.
SMOKE
I’m sorry about that. I feel
somewhat responsible for that
whole thing.
TREVOR
Dude! No! It has nothing to
do with you. I thought it
was the right thing to do.
I would have done it for anybody.
You know how bad I feel. It
it wasn’t for those kids, I
would off myself right now.
SMOKE
Don’t do that.
TREVOR
I’m not going to but if it
wasn’t for them I would. I
gotta get out of here. I’ll
come back later.
The bartender, MIKE, comes over.
TREVOR
How much?
BARTENDER.
Your money is no good here.
TREVOR
Thanks Mike.
SMOKE
Yeah. Thanks Mike.
BARTENDER.
Smoke’s money is good here.
Sixteen.
Trevor walks out the door.
EXT. - APARTMENT - NIGHT
Trevor is knocking on Kim’s door.
TREVOR
Would you open the door. Hello.
Trevor takes out his cell phone and dials a number.
TREVOR
Why would you turn your cell
off?
Trevor continues to knock on the door.
TREVOR
Could you please open the door.
Tears come down his face.
TREVOR
Kim. Please open the door.
EXT - CEMETERY - DAY
Trevor is standing at the front of his sisters and her husbands’ grave. He puts a dozen roses next to her tomb.
TREVOR
I’m so sorry, I just don’t
know what to do. Help me.
What can I do? Am I missing
something?
INT – HOUSE - MORNING
Trevor is sitting on the couch, his hair is a mess and his clothes look disheveled. On the table is half bottle of Jack Daniels. Trevor rubs his eyes. He picks up the bottle and looks at it for a few seconds. He opens it and takes a sip. CeCe is in the other room, looking through the door that is slightly open.
INT - HOUSE - DAY
Trevor is sitting at the kitchen table. CeCe walks into the kitchen.
CECE
Would you like some coffee?
TREVOR
No thanks. Look I don’t know
what’s going to happen with
the house and everything but
you can stay here for as long
as you want or until they say
you can’t. Just so you know,
those kids really love you a lot.
CECE
Thanks. Those kids love you a
lot too. I’m going to visit
them this afternoon if you
want to come.
TREVOR
I don’t know. Maybe it’s
better if I don’t go. The
faster they forget about
me the better they will
be off and then they can
you know start new with a
better life.
CECE
Do you really believe that?
Trevor looks down and than at CeCe.
TREVOR
Yeah, I really believe that.
CECE
I don’t believe that.
Trevor smiles. CeCe smiles.
CECE
Can I ask you a question
about why they call you
two out of three?
TREVOR
Another time.
Trevor gets up and walks out of the room.
CeCe shakes her head.
CECE
Way to go CeCe.
INT - CAR - NIGHT
Trevor and Smoke are driving.
SMOKE
Don’t do it. It’s a crazy idea.
TREVOR
What are you talking about, it’s
a great idea. If she knows that
I am serious about her and then
she will see that I am ready for
a serious commitment.
SMOKE
Are you fucking nuts? Flying
to Florida. Just listen to me.
TREVOR
It will show her that I respect
her family and her by asking
them first.
SMOKE
Would you listen!
TREVOR
Trust me it’s romantic. She
will be impressed.
SMOKE
It’s almost psychotic. It’s
going to make you look crazy.
TREVOR
What are you talking about?
We were together for like
three years. You can’t just
throw away three years.
SMOKE
People break up after ten years,
and then move on. Three years
is nothing.
TREVOR
Maybe for you but to me its a
long time. I asked a few
different women and they
all thought it was a good idea.
SMOKE
What if her parents don’t
want to talk to you? Who
knows what she told them
about you.
TREVOR
Well I gotta try. I’m dying
here. I have no girlfriend,
I lost the kids. I’m about to
my end. I can’t go on like this.
SMOKE
Well, try to concentrate on
getting the kids.
TREVOR
First I have to get Kim back.
SMOKE
This is a bad idea. Asking a
woman’s parents who you’re
not even with that you want
to marry their daughter is crazy.
EXT - CAR - DAY
Smoke is dropping Trevor off in front of Delta Airlines at JFK.
Trevor exits the car and walks in the airline.
INT - AIRPORT - DAY
Trevor is at the ticket window purchasing a ticket.
EXT - FLORIDA - DAY
Trevor exits the airport and waits for the shuttle bus. The bus arrives and he gets on the bus. He dressed in a suit with no luggage.
INT - AVIS RENTAL - DAY
Trevor is at the Avis rental office.
TREVOR
I just need it for one day.
CLERK
As long as you drop it off
by five you will only be
charged one day. Section C,
number eighteen. Keys are
in it.
TREVOR
Thanks.
INT - CAR - DAY.
Trevor is driving on I 95 looking out the window and smiling as he is driving.
TREVOR
I love this weather.
Trevor pulls up to an office building. He parks the car and sits in the car looking at his watch. The watch reads 1:30. Trevor takes a deep breathe and exits the car. He walks into the IBM building.
INT - OFFICE BUILDING - DAY
Trevor walks to the elevator and steps in. He hits the number 7. The elevator closes.
Trevor enters and office door that says IBM. Sitting behind a desk us a secretary, GAIL.
GAIL
Can I help you?
TREVOR
Hi. I’m looking for Mr. Lands
GAIL
Do you have an appointment?
TREVOR
No.
GAIL
Is he expecting you?
TREVOR
Not really. It’s a personal matter.
GAIL
What is your name?
TREVOR
Trevor O’Brien. We know each other.
GAIL
OK. I’ll see if he’s available.
Gail picks up the phone.
GAIL
Is Mr. Lands available? There
is a Trevor O'Brien, waiting
to see him.. OK. I see.
GAIL
Mr. O'Brien, he is not in right
now. He’s in a meeting. Not
sure when he will be done.
TREVOR
Can I just sit and wait?
GAIL
Sure, but I’m not sure when
he will be back.
TREVOR
That's okay. I’ll wait.
Trevor sits at a desk and pick up a magazine from the table. Gail walks to the back offices. Trevor’s watch reads 2:30.
INT - OFFICE - DAY
Trevor looks at his watch which reads 3:00. Trevor’s cell phone rings. He looks at the phone and then pauses. He stands up and walks out of the officer.
EXT - OFFICER - DAY
Trevor is pacing back and forth.
KIM
(voice over)
What are you doing there? Why
are you at my father’s office?
TREVOR
I was in the neighborhood and
wanted to stop by. What is
wrong with you?
KIM
If this is about us?
TREVOR
Relax and don’t flatter
yourself. OK. I was in
the neighborhood.
KIM
Yeah. Sure. Listen. This
better not have anything
to do with us. It’s over.
Why can’t you get that
through your head. I’m
not interested. Move on.
Why can’t you move on?
There is a few second pause.
TREVOR
Because I love you.
KIM
Trevor. No. Well, I don’t
love you. It’s over.
TREVOR
You used to love. How could
you just love someone and
then turn it off and not
love me anymore. That makes
no sense.
KIM
Are you psychotic? Why are you in Florida?
TREVOR
OK. Fine. You want to know
the truth. I’m here cause
I was going to ask your father
if he would mind if I proposed
to you. I want to marry you.
KIM
No Trevor! Are you crazy? I’m
not marrying you. I’m not
interested. That’s it. Leave
my father alone. And move on. It’s over. It’s never going to
happen!
TREVOR
How can you say that to me?
Three years. Over. Just like that.
KIM
I’m done. That's it. Don’t
contact me, move on. Leave
my father alone.
TREVOR
What is your problem?
KIM
I’m hanging up.
TREVOR
Wait. What is your problem?
I love you and you’re treating
me like this!
KIM
I’m hanging up. Goodbye.
TREVOR
Wait. What about....
Trevor looks at his phone. His eyes water up. Trevor walks out of the office into the elevator.
INT - CAR - DAY
Trevor is driving his car on I 95. His speed is accelerating. He is up to 100 miles.
TREVOR
Just do it.
As he is driving fast, his cell phone rings causing his to slow down. He quickly picks it up.
TREVOR
Hello. Oh hey. Dude I’ll
call you back... Later.
INT - AIRPORT - DAY
Trevor is sitting by the gate waiting to board the plane. Trevor picks up his phone and dials a number. It rings and rings. He hangs up. He dials again, no answer. He dials again, no answer. Trevor then dials another number.
TREVOR
Don’t hang up. Listen I’m
sorry for everything. I want
to be with you. We could
get custody of the kids.
KIM
You’re not listening to me.
It’s over. I don’t want to
be with you. I don’t want to
have anything to do with you.
I have to get back to work.
You really have to stop. You
need physiotherapy help.
TREVOR
I don’t understand. For three
years you were in love with
me and now all of a sudden
you’re not. That makes
no sense. I realized I
should have never broke up
with you. I was listening
to the wrong people. You
won’t have to have kids.
We could adopt my sister’s
kids.
KIM
Are you that delusional? You
murdered three people. There
is no way you could get custody.
TREVOR
What are you talking about?
I was never convicted of anything.
If we got married then it could
work. The kids have nothing to
do with it. Even without the
kids. I still want to marry
you. I love you more than
anything in this world. I can’t
live without you. You’re my heart.
KIM
Trevor, I can’t say it any
more clear. I don’t love
you and I don’t want to be
with you.
TREVOR
So you don’t give a fuck about
my feelings? I would never do
this to you.
KIM
I have to go, don’t call me anymore.
TREVOR
Why is ...hello. Fuck.
Trevor dials the phone again. Hangs up dials again. He dials again. Trevor puts the phone in his pocket and slumps in his seat.
INT HOUSE - NIGHT
Trevor is sitting on the couch drinking a beer. CeCe comes upstairs from the basement.
CECE
Hey Trevor. I didn’t know
you were here. I didn't
see you at the Fosters today.
Everything OK?
TREVOR
(slurring))
Not really. How are the kids?
Trevor’s eyes are barely open.
CECE
Are you OK?
TREVOR
Yeah. I’m fine. Just a little
buzzed. You don’t drink, do
you? Do you drink?
CECE
Not really. I like a glass of
wine once in a while.
TREVOR
Oh, OK.
Trevor gets up and walks over to the refrigerator. He takes out a bottle of wine and uncorks it.
TREVOR
Here you go.
CECE
I’m not in the mood.
TREVOR
OK.
Trevor starts drinking from the bottle and continues until half of it is gone. He puts it down.
TREVOR
You can have the rest.
Trevor eyes roll back to his head and he falls on the glass coffee table shattering it. CeCe quickly tries to pick him up. Blood is pouring from his elbow. CeCe runs to the kitchen and gets a towel. She helps him to his feet and he stumbles to the couch. She puts the towel on his elbow and wraps it around. His eyes are open and bloodshot
CECE
Why are you dong this to
yourself?
Trevor sits up on the couch as blood pours down his arm.
TREVOR
(Crying)
I love her. And she doesn’t love me.
Trevor leans back on the couch and his eyes roll. CeCe sits next to him and hugs him. His blood gets on her clothes. Trevor passes out. CeCe sits next to him and just looks at him.
INT - CAR - DAY
Trevor and Smoke are driving in the truck. Smoke has a bandage on his head. Trevor has sunglasses on. They stop the truck at the Foster’s house.
INT - FOSTER HOUSE – DAY
Tina is holding Trevor by the hand walking him into the rooms. She stops at her room. The room is big with two beds. The beds are made and have stuffed animals on them.
TINA
This is my room. I share
with another girl Jenny.
She’s my friend.
TREVOR
Wow. This is a beautiful room.
Do you like it here?
TINA
It’s OK. But I want to go to my
own bedroom. Is it still there?
TREVOR
Yes of course. It’s still there.
TINA
When can we come home?
TREVOR
Soon. I have to try to get something together.
TINA
OK.
Tina leads Trevor out of the room. They see Shelton in his room.
INT - ROOM - DAY
Shelton is on the floor playing with some trucks and army figures. Trevor walks over to him and rubs his head.
TREVOR
Hey buddy. How are you doing?
SHELTON
Good.
TREVOR
What are you playing with the trucks?
SHELTON
Yes.
TREVOR
You having fun? You have a lot of
army figures. Did you know I was
in the Navy.
SHELTON
I know.
Trevor sits down next to Shelton and puts his hand on his shoulder. Shelton looks at him for a second and goes back to his trucks.
TREVOR
Do you want to go outside and
play tag?
SHELTON
No.
TREVOR
How about catch?
SHELTON
No. I just want to play with
my trucks.
TREVOR
Are the Fosters nice? Do you
like it here? It seems fun here.
SHELTON
It’s OK.
INT - HOUSE - DAY
Trevor is sitting at the table talking to the Fosters.
TREVOR
How is everything with the
children? Are they doing OK?
MRS. FOSTER
Tina is amazing. Brilliant.
Shelton is a little shy but
he’s doing well. They are
both bright young children.
MR. FOSTER
They are both adjusting well.
TREVOR
That Tina is sharp.
MRS. FOSTER
She talks about you all the time.
Everyday.
Trevor smiles.
TREVOR
How many kids do you have?
MRS. FOSTER
Right now we have eight.
TREVOR
So don’t you guys get sad
when the kids get adopted.
Don’t you get attached at
some point?
MRS. FOSTER
That happens but we are just
intermediaries. We just show
them love and affection until
a couple who can give a lifetime
of happiness to them are available.
MR. FOSTER
At fifty-five we are not ready to
be raise kids again. Our kids are
grown up.
TREVOR
Then why do it?
MRS. FOSTER
So they are not just placed
in some boarding school or
social service camp where
they will receive no love.
We believe that we saving
some children until they
are properly adopted by
parents who are looking to
adopt.
TREVOR
And you don’t think I’m fit to
raise them properly.
MR. FOSTER
No. Not that at all. You seem
like a great young man but its
just that we believe that a home
for children is with two parents.
MRS. FOSTER
Raising three kids by yourself
is so very hard. We had a
hard time raising two kids
and there were two of us.
TREVOR
So you think that they would be
better off being adopted by a couple.
MRS. FOSTER
There are so many couples that
can’t have children that would
be so happy to adopt them.
MR. FOSTER
So many people would love to
adopt all three.
TREVOR
So you think I should just give
up what little right I have
and just sign the paper
allowing the adoption to
go through.
MR. FOSTER
At this point you have to look
to see what is best for the children.
INT - BAR - NIGHT
Trevor and Smoke are at the bar eating.
TREVOR
It was a fucking disaster. It
was a mess. I didn't even see
the old man. And then she called.
It was a mess.
SMOKE
I told you it was a bad idea. I
don’t understand. You broke up
with her. I thought the age thing
bothered you. And the kid thing.
TREVOR
I did but now even if we were
together she wouldn’t have to
have kids. It would be so perfect.
SMOKE
Brother you have to let it go.
You’re going to wind up in the
fucking loony bin at Creedmore.
TREVOR
I already belong there. It’s so
messed up. Had I just waited
and not broke it off we could be
together living with the kids.
SMOKE
Let me ask you something. Whose
more important the kids or
her? If you could only have
one which would you choose.
Trevor pauses a minute.
SMOKE
Dude that's fucked up. You
shouldn’t even have to think.
The kids should be the first
priority.
TREVOR
They are. You didn’t give me
a chance to respond. Of course
the kids.
SMOKE
I don’t believe you.
At the front of the bar CeCe walks in. She looks around the bar. She is in tight jeans with black boots. Her hair is straight down and she looks very attractive. All the guys in the bar are looking at her. She see’s Trevor and runs over to him. She says something to him and they both run out the door.
INT - HOSPITAL - NIGHT
Trevor and CeCe are in the waiting room in the hospital.
TREVOR
Twelve stitches is a lot for
a kid. Especially in the head.
CECE
It is but at least the doctor
said he will be fine.
TREVOR
You look a lot different. Usually
you’re in dress with your hair
pulled back or you’re sweats.
You look like two different people.
CECE
Do I look sexy?
TREVOR
Yeah. You look good.
The doctor walks in the room.
DOCTOR
He’s okay. A little banged up
and scared but he’s fine. He
banged his head and was bleeding.
We stapled him up. The Fosters
are in there now.
TREVOR
Can we go in?
DOCTOR
Sure, he’s in recovery. Around
the corner in room eight.
CECE
Thank you doctor.
INT - RECOVERY ROOM - NIGHT.
The Fosters are in the room with Shelton. Shelton is sitting in a chair. Trevor shakes hands with the Fosters.
MR. FOSTER
We’ll be back in a minute Shelton.
The Fosters walk out the room. CeCe hugs Shelton.
CECE
You Ok hun?
SHELTON
I fell off my bike.
CECE
It’s OK baby. You’re
going to be fine.
TREVOR
Yeah. You’re going to be OK buddy.
Trevor puts his hand on his shoulder. Shelton squeezes CeCe harder.
INT - CAR - NIGHT
CECE
He loves you.
TREVOR
I don’t know. He always gives me the cold shoulder.
CECE
What do you expect? He thinks
you abandoned him.
TREVOR
I know, but what can I do to
change that? I mean I know
he’s too young to understand.
CECE
You have to get them back.
TREVOR
How? I’m trying to get a
respectable job but its hard.
CeCe takes out a paper from her purse.
CECE
Remember when the police gave
you that application outside
the court house.
TREVOR
Yeah.
CECE
Well I mailed it in for you
and they responded. The next
test date is in 2 weeks. You
should take it. That's a
respectable job and there is
a good chance that you could
get the children back.
CeCe hands him the paper.
TREVOR
A cop. Never thought about that.
That is a respectable job and they
can’t say that I’m not responsible
because the city would be giving
me a gun to protect society.
CECE
You were never convicted of a crime.
TREVOR
Yeah. Never convicted. Only charged
and found innocent.
CECE
Then they can’t discriminate against
you. Besides that, they would
probably have to take you because
they might be afraid that you would
sue the city. This is a good
chance to get the children.
INT – PAUL’S OFFICE – DAY
PAUL
Sounds good to me. Why not.
You have the sixty credits.
You have military experience
which they love. The only
downfall is the three guys
but that could work for us.
It’s illegal to discriminate
and you were never convicted.
If they give you a hard time,
I’ll threaten lawsuits and all
that.
TREVOR
Cool. Let’s do it.
PAUL
Just pass the test. It shouldn’t
be that hard. It’s a city
test. You only have about
six months left before they
can decide if the kids can be
legally adopted by a family.
Of course I can delay the
proceedings but we have to
get this ball rolling. And
to be honest with you. This
police job is probably your
best and only chance to get
custody.
TREVOR
OK cool. Thanks. Thanks for
everything. Holding the house, and
going to bat for me. I really
appreciate it. Just bear with
me for a little while.
PAUL
I’m going out on a limb for you.
Don’t fuck me. Stay the course.
And stop drinking. A DWI blows
everything. A bar fight can blow
everything. Just don’t do anything
stupid.
TREVOR
No problem.
INT - HOUSE - DAY
Trevor is sitting at the table reading a police study guide.
CECE
I think you’re going to do
great on the test. You’re
going to get the kids, and
one day when they are older
they are going to owe you their
lives.
TREVOR
You think?
CECE
Yes. I do.
TREVOR
It’s still a long shot. But
hopefully God will give me
this one.
CECE
I’ll say a prayer at church
this morning.
TREVOR
Why so early?
CECE
I want to go see the children
this afternoon.
TREVOR
OK. Good. I’m going to go tomorrow
afternoon. I want to take them
out for ice cream but Shelton
is still unresponsive. That's
another obstacle. There are so
many obstacles in the way for
me to get the children.
CECE
You will overcome all of that and
get the children.
TREVOR
Why do you always stick up for me?
Why are you always so positive?
CECE
I believe that good things happen
to good people.
TREVOR
I’m not a good person.
CECE
You are. Trust me I’ve seen bad
people.
Trevor laughs.
TREVOR
What do you know about bad people?
You’re from sunny South Carolina.
CECE
You think you’re the only one with
a past?
TREVOR
What past do you have?
CECE
It’s a long story. I’ll tell
you when I’m drunk one night.
Trevor laughs.
TREVOR
That's my line.
CECE
Mine too.
INT - FOSTER HOUSE - DAY
Trevor is playing tag with Tina as Shelton watches. Trevor tries to get Shelton involved. Shelton just watches as Trevor and Tina run around.
INT - HOUSE - NIGHT
Trevor is sitting at the table reading the police study guide.
INT - CHURCH - DAY
CeCe is at church with Tina and Shelton
INT - PARK - NIGHT
Trevor and Smoke are sitting on the bench. Smoke is drinking a forty ounce beer. He passes it to Trevor.
SMOKE
Big day tomorrow, huh.
TREVOR
Yeah. I’ve been studying like crazy.
SMOKE
What the fuck you studying for?
You’re going to get a hundred.
TREVOR
I hope, but you never know. It’s a
civil service test. It could be hard.
SMOKE
You got a fifteen hundred on your
SATS. You are over qualified.
How hard can it be? You see the
dopes in civil service. Most of
the cops are idiots.
TREVOR
Really! Well, you get caught by
the cops all the time so what
does that make you?
Smoke laughs.
SMOKE
True. I’m just lazy. Nobody goes to
jail unless they want to. You know
who goes to jail. Lazy stick up
men who fall behind the wheel of
the getaway car.
TREVOR
OK Henry Hill.
SMOKE
By the way that CeCe looked smoking
hot in the bar that night.
TREVOR
Come on chill. She’s a nice girl.
SMOKE
I’m just fucking around but she
did look hot. I’ve never been
with a black chick but her I
would. I mean I wouldn’t go
out with her but I’d fuck her.
TREVOR
You’re an idiot. I’m sure she
would go out with you. How
could she resist.
SMOKE
You going to be at the bar later?
TREVOR
No. I’m going to go to bed early
and just relax. I have to be
in Manhattan early for the test.
What are you doing tonight?
SMOKE
I don’t know if I should say it,
now that you’re going to be a
copper... I actually have a
little heist lined up. I was
hoping to use you as an alibi
if you were going to be at the bar.
TREVOR
What time are you going to be there at?
SMOKE
Like twelve.
TREVOR
Alright. If you need me there just
to hang, no problem, but I can’t
drink or nothing.
SMOKE
Nothing like that. Just kind of
be there at twelve and just hang out.
TREVOR
OK. No problem.
INT - HOUSE - NIGHT
Trevor is reading the police manual. The clock on the wall reads 11:30. Trevor stands up and walks out the door.
INT - BAR – NIGHT
Trevor is at the bar talking to the bartender. The place is filled with people. Different people are coming up to Trevor shaking his hand. He is talking to other patrons. He looks at his watch. It reads 12:45. He looks around and walks out the door.
EXT - NYPD TESTING CENTER - DAY
Trevor is on line outside a high school. The line goes around the block.
INT - NYPD TESTING CENTER - DAY
Trevor is sitting at a desk in an auditorium. This auditorium is filled people taking the test.
INT - HOUSE - NIGHT
CeCe is sitting at the kitchen table looking at her watch. She is dressed in a beautiful black dress and high heels. There is a bottle of wine. She keeps looking in the mirror and looking out the window.
EXT - HOUSE - NIGHT
Trevor pulls into the driveway. He and Smoke step out of the truck.
INT - HOUSE - NIGHT
CeCe looks out the widow. She quickly grabs the wine and runs down stairs. Trevor and Smoke enter the house.
INT - HOUSE, BASEMENT - NIGHT
CeCe quickly pulls her dress over here head. Underneath the dress she is in a black thong and matching bra. She quickly takes off her stockings and puts a pair of sweatpants on. She puts her ear to the door.
EXT – KIM’S APARTMENT - NIGHT
Trevor is knocking on Kim’s door. A man, STEVE, of about forty comes to the door. He is well dressed with dress pants and a buttoned shirt.
STEVE
Can I help you?
TREVOR
Where’s Kim?
STEVE
Who are you?
TREVOR
Trevor. Who are you?
STEVE
OK. Trevor. I’m Steve, a friend
of Kim’s.
TREVOR
Where’s Kim?
STEVE
She’s not here.
TREVOR
Where is she?
STEVE
I don’t know. She’s out.
TREVOR
You don’t know. No idea right.
Steve opens the door.
STEVE
See. She’s not here. Can I
give you some advice? Let
it go. Nothing good can
come from you acting crazy.
Just move on.
Trevor just stares at him. Steve closes the door.
INT - CAR - NIGHT
Trevor is driving and drinking a bottle of Jack Daniels. As he is driving on the far left lane of the highway he drops his cell phone on the passenger floor. He bends down to pick it up. As he does his car goes up on the left side of the highway almost hitting the guard rail. He quickly grabs the wheel. The car spins out of control. He swerves to the left and then the right. The car does a 360 and skids out on the right of way on the right side of the highway near some bushes. He gets out of the car and looks around. No cars are near him. He looks at the tires and none are flat. He takes the bottle of Jack Daniels and throws it in the bushes. He starts the car, puts his seat belt on and cautiously drives in the right lane with both hands on the wheel.
INT - HOUSE - NIGHT
Trevor is at the sink washing his face. Looking in the mirror. He looks up from the sink and is startled by CeCe standing there. He jumps back.
TREVOR
What the fuck! You scared the
shit out of me.
CECE
I’m sorry.
Trevor laughs and then almost cries but quickly stops himself.
CECE
Are you OK.
TREVOR
I don’t know.
Trevor opens the draw and takes out a pair of scissors.
TREVOR
Watch this.
Trevor grabs his ponytail and cuts it off.
CECE
What are you doing?
He rips his shirt off and takes one blade of the scissor and slides the blade down his chest. Blood pours from his chest.
CECE
What are you doing? Stop!
Trevor stops and looks at her. He drops the scissors to the floor.
CECE
Trevor what are you doing to
yourself?
CeCe takes a towel and wets it. She rubs his chest as just looks at the floor. He bawls as she wipes him chest.
CECE
Trevor. Why are you doing this?
Trevor looks at her.
TREVOR
I can’t take it anymore.
CECE
Can’t take what? What’s wrong?
Trevor continues to bawl. He sinks to the floor. CeCe gets down on the floor with him. Trevor leans against the wall.
TREVOR
This woman is making me go crazy.
I want her, miss her, and she
doesn’t want anything to do with
me. My heart feels ripped out. It
just hurts so bad. I can’t take it.
CeCe holds his hands.
CECE
I’m here for you. Whatever
you need. I’m here.
TREVOR
I just can’t deal with it anymore.
If she wasn’t being such a pain
in the ass, we could be together
and raise the kids, and everything
would be perfect. It would be a
perfect situation but she’s being
such a bitch. Fuckin bitch.
CECE
Maybe you two are not made to be
together. Maybe you guys are just
two different people.
TREVOR
I’ve been making an ass of myself.
E-mails, texts, phone calls.
And all she does is be a bitch.
I went over there and a guy answered
the door.
CECE
What happened?
TREVOR
Nothing. He said she wasn’t
there and I left.
CECE
Trevor, please don’t do anything
that will get you in trouble. If
you do anything crazy, you will
never get the kids.
TREVOR
I did two years in the military
and one year in jail. Been
through some crazy shit and
never cried in twenty-seven
years. Now I cry everyday over
a woman that doesn’t even want
to be with me.
Trevor puts his hands on his face.
TREVOR
I can’t take it anymore.
CECE
You have too. You have to
overcome this and concentrate
on the kids. Think about their
situation. I know you may think
you are losing it, but think
about how those kids feel about
losing their parents. Their
pain will be with them for the
rest of their lives. Please
Trevor.
Trevor looks at her and shakes his head.
TREVOR
I know you right. It’s just hard.
CECE
I know. If you ever want to talk
about anything. I’m here.
TREVOR
Thanks. I appreciate it.
INT - HOUSE - DAY
Trevor is making breakfast as Smoke is sitting at the kitchen table playing a PSP 3000 game.
SMOKE
These Germans are like rats.
They’re everywhere. How do
you like that Adolf. You
cocksucker. Stalin is going to
light your ass up.
CeCe walks in the door carry some bags.
TREVOR
Hey CeCe.
SMOKE
Hey.
CECE
Hey guys. Trevor your hair looks
good.
TREVOR
Yeah. I went to the barber and had
him tighten it up.
CECE
You look good with short hair.
SMOKE
Oh shit, you cut your hair!
TREVOR
Great Detective work.
CeCe walks toward the basement door. Trevor follows her.
TREVOR
I just wanted to say...
SMOKE
Your eggs are burning.
TREVOR
I’ll talk to you later.
CECE
No, what?
SMOKE
Trevor.
TREVOR
OK, I’m coming. I’ll talk
to you later.
CECE
OK.
TREVOR
OK. Cool.
Trevor walks back to the kitchen. CeCe get a frustrated look on her face.
INT - RESTAURANT - DAY
Trevor walks into a restaurant with his lawyer Paul, and a friend Mike.
PAUL
Hey Trevor. Have a seat. This
is Mike, one of the partners
in the firm.
Trevor nods to him.
PAUL
Well the good news is that
you got a hundred on the test.
The bad news is that the media
caught wind of it. So I would
expect a little article on the
anniversary of the case.
TREVOR
Is that good or bad?
PAUL
I think it’s good. You got a
hundred so they can’t just
dismiss you or say you didn’t
score high enough.
TREVOR
What about the media?
PAUL
New York media. It is what
it is.
MIKE
With the media involved the police
department will not risk being
sued again. You sued and won.
The last thing they would want
is to be sued again. Even if it’s
unfounded the media would be all
over them.
PAUL
You are already a hero to most
people in New York. The NYPD
would be foolish to not hire you.
It would be a PR nightmare.
MIKE
Just stay out of trouble. The
scores will be online tomorrow
so you can see it. You’re in
a good spot. The NYPD is so
desperate for cops that they
recruiting like crazy. They are
so desperate that they are trying
to put a class in by November.
TREVOR
That's only four months away.
MIKE
The Physical part starts in
two weeks. That should be
easy for you. After that and
the medical all you have
would be the psychological.
TREVOR
That’s the part where they could
screw me.
MIKE
No. They can’t because Paul can
petition the NYPD to be present.
DAN
The media would love it. The
NYPD would be under such scrutiny
if they don’t take you. As long
as you don’t say anything crazy
at the psyche test. But don’t worry
about that, I will prep you before
that happens. In the meantime just
get in shape and out of trouble. And
don't blow the psyche test.
Trevor smiles.
TREVOR
This is the best news that I
have heard in a while.
INT - CAR - DAY
Trevor is driving in his truck. He dials a number.
TREVOR
Kim. Pick up if you’re there.
Hello. Kim pick up.
Trevor hangs up the phone and redials.
TREVOR
Hello. Is Kim Lands in?
There is a few second pause.
TREVOR
Kim. Guess what. I got a hundred
on the NYPD test... What are
you talking about. I’m just
trying to tell you...Why are
you being such a bitch. You
should be happy for me.. Hello.
Hello. Hello...
Trevor closes the phone and drops it on the seat.
EXT - FOSTER HOUSE - DAY
Trevor is outside the house with a shopping bag. Tina and Shelton come outside. Tina runs and jumps into Trevor’s arms. Shelton just stands next to Trevor. Trevor opens the bag.
TREVOR
Look what I got in here.
TINA
Presents.
TREVOR
You got it.
Trevor takes a Lego box from the bag. On the box is a picture of a ship.
TINA
Oh man. That's awesome.
Shelton loves pirate ships.
TREVOR
You like it Shelton?
SHELTON
Thanks.
TREVOR
You’re welcome.
Trevor takes out a Barbie doll from the bag.
TINA
Summer Barbie. I wanted this so bad.
Tina hugs Trevor.
TREVOR
You like it.
TINA
I love it!
TREVOR
Shelton, when you’re done
with that one. I saw a Lego
battle ship, It’s like four
thousand pieces, I’ll get you
the battle ship. And soon, you
guys will be back at your own
house and we can make a room
just for all your Legos.
TINA
That's so cool. And maybe a
room for all my Barbie’s.
TREVOR
Sure. Why not?
INT - DOCTORS OFFICE - DAY
Trevor is on line with about ten other guys waiting to go into the doctor’s office.
INT - POLICE ACADEMY - DAY
There is a line of men standing near a car. They all have sweatpants and sneakers on. There are academy instructors near the car. One is holding a clipboard while the other is holding a stopwatch. The man inside the car gives the thumbs up to the instructor outside the car. He then quickly exits the car and runs along a line leading to the next room. The next person enters the car and gives the thumbs up.
INT - POLICE ACADEMY - DAY
Trevor is standing with a group of other men. Each man is holding a piece of paper. They all shake hands with the instructors and exit the academy. Trevor is about to exit the academy when he sees’s a news crew. He turns around walks back toward the instructors. He says something to them and they lead him through a different door.
INT - HOUSE- NIGHT
CeCe is sitting at the living room looking out the window. The clock reads 9:00. CeCe is still sitting at the couch the clock reads 11:00
CeCe looks at the clock and it reads 1:00 She gets up and is about to walk out of the living room when she sees’s a car pull into the driveway. She looks in the mirror to fix her hair. She is wearing a tight pair of jeans and black heels boots. Trevor enters the front door and sees her sitting there.
TREVOR
Hey. What are you doing up?
CECE
Just watching a movie.
TREVOR
Cool. What movie?
CECE
Its, its, um I forgot the name.
The Italian Job.
TREVOR
OK. Cool. Well I’m beat. I’m
going to bed.
Trevor walks toward the stairs.
CECE
Wait.
Trevor looks surprised.
TREVOR
What’s up?
CECE
Can I tell you something?
TREVOR
Sure.
CECE
Well. I just want to say that
I think you’re a really great
person. And I know you are
going to get the children back.
TREVOR
Well just one more hurdle, the
psychological. That's the hard one.
CECE
I know you’re going to make it.
TREVOR
What is with you? Why are you
always saying how good I am and
how I’m so great. What’s with you.
CeCe takes a deep breathe.
CECE
I read about your situation
with what happened and everything.
TREVOR
OK.
CECE
Well. I’m just glad you did
what you did.
TREVOR
What are you talking about? Do
you know what I did?
CECE
Yeah.
TREVOR
And you think I was right even
though many people didn’t
believe me.
CeCe eyes swell up.
TREVOR
What’s wrong? Why are you crying?
CECE
I was raped by three people when
I lived in South Carolina. That’s
why I moved up here.
Trevor’s eyes open wide.
CECE
Three guys raped me and got away
with it. I never told anyone.
Not even my family. Nobody knows.
TREVOR
So why are you telling me?
CECE
Because you killing those three
guys make me feel better. In my
head I make believe that you
killed the three guys who raped
me. I wish someone would have
saved me like you did.
Trevor sits beside her. She puts her head on his shoulder.
TREVOR
I’m really sorry. Did they ever
catch the guys?
CECE
No.
TREVOR
What do you mean? Did you know
who did it.
CECE
Not really, I kind of did, I
was at a party and it just
happened. I was drunk.
TREVOR
So you never reported it.
CECE
No.
TREVOR
That's messed up. You should
have reported it.
CECE
I was just so embarrassed. Then
my family would have found out,
so I thought it was just better
to just act like it didn’t happen.
TREVOR
I’m really sorry.
CECE
It’s not your fault, I was
somewhere I shouldn’t have been.
I was pretty wild at my job when
I was young.
TREVOR
Wild. What were you a librarian?
Or work in a book store.
CeCe smiles.
CECE
I wish I did.
TREVOR
You seem like an innocent girl.
What could you have done? I’m
sorry for what happened to you.
CECE
When you get your police uniform,
I’ll wear my old work uniform for you.
Trevor smiles.
TREVOR
I’m sure that's sexy.
CECE
So that's why I look up to you
so much and compliment you.
Trevor looks at CeCe’s head as it is resting on his shoulder.
TREVOR
So you moved to New York to get
away from that. So how did you
wind up working for my sister?
CECE
I was filling in for a friend
who was baby-sitting for your
sister. Your sister liked me so
they asked me to be the nanny.
TREVOR
I thought you went to nursing
school or something.
CECE
I did. I’m an RN. As partial
payment your sister would pay for
my school.
TREVOR
You’re an RN? That's big. They
make good money. Why didn’t you
go work in a hospital?
CECE
Your sister was good to me and I
loved the kids.
TREVOR
Where are your parents?
CECE
In South Carolina. That’s a whole
different story.
TREVOR
What do you mean?
CECE
They are Jehovah Witness. It’s a
crazy situation. I don’t even
want to get into that.
TREVOR
OK. I understand.
CECE
Thanks.
TREVOR
(laughing)
Did you go and knock on peoples
door.
CeCe picks her head up and smiles. He takes her head and puts in back on his shoulder.
INT - LAWYER’S OFFICE - DAY
Paul is sitting behind his desk on the phone as Trevor is looking at the degrees on the wall. Paul hangs up the phone.
PAUL
This is it. One psyche test away.
I can’t believe you got this far.
TREVOR
Crazy right?
PAUL
Well, don’t worry because I’m going to
be with you at the psychological
test. I have a few pointers on what
to say because they are going to
ask you some simple questions that
most people slip on.
TREVOR
Like what?
PAUL
For one, they are going to ask you to
draw a house. Simple enough to draw
a house. They don’t only want a house
they want to see a house, grass, trees,
the sun, people and bunch of things
that makes you seem like you are a happy
person.
TREVOR
Good thing you told me. I would have
just drawn a house.
PAUL
There are some other things. They like
people with wives or girlfriends
and that you love children. So tell
them you have a girlfriend. You two
get along great. Also, say that you
never drink. Maybe only at a wedding.
TREVOR
Yeah. I hardly ever drink.
Trevor laughs.
PAUL
I’m going to be right outside the door
so the psychologist sees me, and
make sure that you say you have your
lawyer outside. Just kind of say it
in passing. This test is tough one,
we need every edge we can get.
TREVOR
OK. Cool.
PAUL
You already sued once and won. We
have to scare them into thinking
that if they turn you down that
we will sue again. Hopefully
they will be too scared to turn
you down.
TREVOR
OK. Sounds good.
EXT - CAR - DAY
Trevor drives by the Foster house and sees Tina and Shelton playing with the other children. They are running around playing tag.
INT - PRISON - DAY
Trevor is sitting next to Smoke. Smoke is in an orange prison jumpsuit.
TREVOR
What the hell happened?
SMOKE
What a set up job.
Smoke laughs.
TREVOR
Yeah. Big set up.
SMOKE
Well. I didn’t actually get
caught with anything, Luckily
I ditched it. Do you miss this
place?
TREVOR
You’re an idiot.
SMOKE
I heard some guys talking about you.
They must have read the article in
the paper about you becoming a cop.
A couple of the inmates asked for
applications for NYPD. Dead serious.
TREVOR
Great. So when are you getting out?
Couple weeks I think. They thought
I had a gun but never found it so
they couldn’t charge me with that.
Only some minor cocaine.
TREVOR
Alright. That's good then. When
you get out, you gotta chill and
think about doing something else
except scams.
SMOKE
I know. I gotta straighten out.
TREVOR
One day you’re going to get some
serious time.
SMOKE
I know, I know. Anyway, what’s
going on with you and the NYPD?
I can’t believe you’re going to be
a pig. How close are you? Is it
going to happen?
TREVOR
Pretty close. I just have the
psychological test. But that's
the hardest part because they
could put anything against you.
The only good thing is that my
lawyer is going to be outside there
to hopefully to put a little
question in their mind that I
will sue if they turn me down.
But the problem is yeah, I can
sue but that won’t help me get
the kids. I’m starting to kind
of doubt that even if I get the
kids, if living with me is the
best thing.
SMOKE
Wow. Well then there's no point
going through with the police
thing if you don’t plan on getting
the kids. I thought you were
dying to get the kids.
TREVOR
I’m just confused.
SMOKE
You have to ask yourself if you
are ready to take on the
responsibility of raising three
kids. That's a big responsibility.
You’re only going to be twenty-eight.
For the next twenty years, you will
be responsible for them. It’s a
big decision.
Trevor shakes his head.
TREVOR
I gotta talk to Kim. She could
help me.
SMOKE
You’re still hooked on her! Come
on man! You’re letting this girl
ruin your life.
TREVOR
It’s not like that.
SMOKE
Trevor. You’re my best and only
friend so I’m going to tell you the
truth...
TREVOR
What?
SMOKE
She don’t want nothing to do with
you. I seen her holding hands with
another guy a few weeks ago.
TREVOR
So what does that mean. Maybe she
was just seeing someone then and
not anymore. We were together for
three years. She couldn’t have
feelings for three years and just
turn it off.
SMOKE
Trevor. You sound crazy! People are
married for ten years and then
leave each other and never look
back. Three years is nothing.
Everybody breaks up. That's life.
TREVOR
Exactly. Maybe she was seeing someone
and they broke up. Or I could wait it
out and then get back with her.
SMOKE
She has told you like how many times
to never to contact her. She doesn’t
return your calls or answer her door.
It’s fuckin over. You look crazy
pursuing her!
TREVOR
I don’t care if I look crazy. I
love her. If you love someone
you don’t give up. How do you
turn your back on love? If you
really love someone you don’t
give up.
Smoke shakes his head.
SMOKE
Why don’t you go out with CeCe. I
think she’s hot and she’s good
with the kids. Maybe you need
some chocolate in your life.
TREVOR
Stop fucking around.
SMOKE
I’m not.
TREVOR
I really love her. Sometimes I
can’t breathe without her.
SMOKE
Dude, you’re a fucking good looking
guy. You can get any girl. Move on.
TREVOR
That's easy for you to say. I think
about her all the time.
Smoke looks mad as he stands up.
SMOKE
Stop your fuckin shit. The fucking
girl doesn’t love you. Jesus fuckin
Christ. You sound like a pussy.
You’re Mr. Two out of three. You’re
a tough guy. A fuckin Marine for
Christ sake. Look in the fuckin
mirror and be a fuckin man. Move
the fuck on.
Trevor looks shocked. Smoke walks toward guards.
EXT - APARTMENT - NIGHT
Trevor is knocking at Kim’s door. He takes his cell phone from and dials a number and puts his ear to the door.
TREVOR
Kim. Open the door. Open the door.
Trevor kicks the door. Trevor sits
at the steps. Up the steps comes
Steve, the same man who was in Kim's
apartment the last time.
STEVE
What are you doing here?
TREVOR
Where’s Kim?
STEVE
Not here. I suggest you leave now
and leave her alone.
TREVOR
Is that what you suggest? We were
together for three years so mind
your fucking business.
STEVE
Well that's over.
TREVOR
Who the fuck are you? You better
mind your business. Where is she?
Steve takes his wallet out of his pocket and shows Trevor his badge.
STEVE
I’m a New York State Trooper.
Steve lifts up his shirt revealing his gun.
TREVOR
You got a gun. Big fuckin deal.
I’ve had guns pointed at my head
before. You think I’m fucking
impressed. I’ll take that gun
and stick it up your ass.
Steve takes the gun out of his holster and holds it in his hand.
STEVE
You better relax.
Trevor walks toward Steve.
TREVOR
Do it. I dare you.
STEVE
Don’t fuckin move.
Trevor rips his shirt off. His tightens his fists causing his body to look muscular.
TREVOR
Do it. You fucking pussy.
He slowly walks toward Steve. Steve points the gun at Trevor’s head. A car screeches to a halt. In the car is CeCe.
CECE
Trevor. There was an accident
at the Fosters. Come quick.
Trevor runs down the stairs.
EXT - FOSTER HOUSE - NIGHT
CeCe and Trevor pull up to the house. There are cop cars around the house. Police officers are talking to the Fosters. Trevor runs up to
Mr. Foster.
TREVOR
What happened?
MR. FOSTER
We had a break in. All the
children are fine.
TREVOR
Where’s the kids.
OFFICER
Who are you?
TREVOR
Trevor O’Brien, who the hell
are you. Where are they?
OFFICER
Excuse me?
TREVOR
You’re excused. I’m their fuckin
uncle.
Trevor walks past the officer and Mr. Foster. He walks into the house.
INT - BEDROOM - NIGHT
Tina and Shelton are looking out the window. Tina runs to Trevor and jumps in his arms.
TINA
Uncle, I want to go home. I don’t
like it here anymore. I want to go
to my old bedroom.
TREVOR
Very soon.
TINA
Are you sure? How much longer?
TREVOR
Very soon.
Trevor puts her down in her bed and walks to Shelton.
TREVOR
How are you champ?
SHELTON
Good.
TREVOR
You know I miss playing with you.
Remember we had that snowball fight
and we built the big fort. Then
you came and crushed mine.
Shelton picks up a toy and plays with it.
TREVOR
Do you like it here?
SHELTON
No.
TREVOR
Do you want to come to your
old house and room?
Shelton doesn’t answer.
SHELTON
Shelton I have to know. Would you
rather stay here or come to your
old house.
Shelton doesn’t answer and lays in the bed.
TINA
He wants to go home. He told
me the other day. We both
want to go home.
TREVOR
OK. I just need some more time.
OK. I promise. Very soon. I
have one more obstacle to overcome.
Tina hugs Trevor
TINA
OK. I love you Uncle.
INT - NYPD TESTING CENTER - DAY
Trevor is sitting outside an office dressed in a suit. Next to him is his lawyer Paul. A man comes out the office and walks to the elevator. A woman, MRS. CANTOS, comes outside and sees Trevor and his lawyer.
MRS. CANTOS
Mr. O’Brien. Please come in.
PAUL
Hi ma’am. How are you?
MRS. CANTOS
Fine.
PAUL
I’m Mr. O’Brien’s lawyer, Paul
Wargins. I would like to be
present during his psychological
testing.
MRS. CANTOS
No one is allowed inside during
testing. Sorry.
PAUL
Really? I was told that I could
be inside.
MRS. CANTOS
I was never notified and they never
allow lawyers or others inside.
PAUL
Interesting. OK.
Trevor gets up and walks in the office.
INT - OFFICE - DAY
MRS. CANTOS
How are you Trevor?
TREVOR
Fine. Thanks. Sorry about that.
My lawyer is afraid that the NYPD
might try to not let me on. He’s
sue crazy, but he’s a nice guy.
Anyway, how do you like this warm
weather?
MRS. CANTOS
If I was you I would have done the
same thing..
Trevor looks confused for a second.
MRS. CANTOS
About bringing a lawyer.
MRS. CANTOS
OK. Lets begin the evaluation.
EXT - BACKYARD - NIGHT
Trevor is sitting on the deck on a chair watching the sky. CeCe comes from around the back.
CECE
Hi Trevor. How did the test go?
TREVOR
I think it went good. The lady
seemed nice. Now it’s just a
waiting game.
CECE
That's great. That’s fantastic.
You don’t seem thrilled.
TREVOR
I am. I’m just waiting to see.
CECE
I know why you’re not thrilled.
TREVOR
No you don’t.
CECE
Does it have something to do
with when you were at your ex’s
the other night?
TREVOR
No. Not at all. If this doesn’t
work, what are you going to do? Go
to the hospital and do the RN
thing.
CECE
Yes. That's exactly what I will do.
If you’re an RN, you easily get a
job at a hospital.
TREVOR
If this doesn’t work out, I’m going
down south for a change of scenery.
CECE
OK.
CeCe continues walking to the outside basement entrance.
INT - NYPD POLICE ACADEMY - DAY
Inside an office are an Inspector, a Captain, and a SGT.
CAPTAIN
He passed.
The Sgt is reading a newspaper.
SGT
Trevor O’Brien AKA two out of
three kid is close to becoming
a New York Police officer.
O'Brien who gained fame for
killing three suspected rapists,
will possibly enter the NYPD in
two months when the NYPD puts in
the biggest class in twenty years,
Mr. O’Brien bla, bla, bla.
INSPECTOR
There is no way around it. Can you
imagine the shit storm if he doesn’t
get in. It will be open season
with the lawsuits. The media
would be all over us especially
with his sisters death and the
adoption thing. Whether we like
it or not, he’s going to be a cop.
SGT
I think he was guilty but whatever.
He was cleared.
INSPECTOR
I kind of believe his story. It was
his cockiness that got him in trouble.
The Inspector hits power on the remote control. On the television is Trevor. He looks about twenty one. He is being led in handcuff by two police officers. A reporter puts the microphone is his face.
REPORTER
How do you feel knowing that
you killed two out of three
suspects in a suspicious homicide?
TREVOR
Well, two out of three isn’t bad.
The reporter looks shocked. The inspector turns the television off.
The Captain laughs.
INSPECTOR
It’s not funny.
CAPTAIN
Look, if it was fagazzi at least
he did take three career criminals
who all had extensive rap sheets
off the streets.
SGT
I’m sure those guys raped some
woman before that anyway.
CAPTAIN
We don’t know that for sure.
SGT
Come on. These guys got what they
deserved. I’m sure they killed a few
people in their day.
CAPTAIN
What do you think he’s a Bernard Goetz.
They laugh.
INSPECTOR
Regardless of when he gets here,
treat him just like everybody else.
Make sure the instructors know. The
last thing we need is some idiot
saying something inappropriate.
Just treat him like everyone else.
Last thing we need is a lawsuit.
EXT - APARMENT - NIGHT
Smoke and another man, JAX, are sitting at a table. Jax is a huge man of about two hundred and sixty pounds. He has scraggly black hair. Two Hispanic men walk in carry a suitcase. They open the suitcase revealing a suitcase filled with cocaine. The two Hispanic men look at each other and pull out their guns. Smoke and Jax pull out their guns. They both fire rounds. All four are hit. All for are lying on the ground. Smoke struggles to his feet. He limps to Jax. Smoke takes off a bullet proof vest. He helps Jax up. Jax struggles to get his vest off. Smoke takes the suitcase and he and jay walk toward the door. Smoke turns back to the two Hispanic man and fires point blank in their heads.
EXT - FOSTER HOUSE - DAY
CeCe pulls up to the house as the children are playing on in the yard. Tina and Shelton see CeCe and come running to her. She hugs them both.
CeCe
I have some great news.
INT - RESTAURANT - NIGHT
Trevor and CeCe are sitting at a table in an Italian restaurant. CeCe is in a black dress with heels. Her hair is long and straight.
TREVOR
I can’t believe it.
CECE
I can. I’m so happy for you.
I knew you would do it.
TREVOR
Well, I’m not there yet. Anything
can happen between now and then.
Realistically, the judge can still
say no.
CECE
They have to say yes. How could
he not. You will be a police
officer. That’s the bravest job
there is.
TREVOR
Well I hope they see it that way.
CECE
They will.
TREVOR
If they don’t, I’m gone. Forget the
NYPD. I’m going to San Diego.
CECE
You wouldn’t want to be a police
officer?
TREVOR
I have no desire to be a cop. I
only want it so I can get the
children. I wouldn’t mind being
a fireman in New York but not a cop.
CECE
Well I think you’re going to get
custody.
TREVOR
I have a question. How do you get
your hair so straight.
CeCe laughs.
CECE
It’s a relaxer. A hair straightener.
TREVOR
Is it your real hair?
CECE
What do you think it’s a weave?
TREVOR
Kind of.
CECE
It’s my real hair. Not all
black girls have fake hair.
CeCe smiles.
TREVOR
I figured it was yours, just making
sure. I don’t want some animal
jumping out of your head.
Trevor laughs.
TREVOR
All kidding aside, if I do get custody,
I hope you stay on as the nanny. If
the state won’t pay, I could pay
and you could live free in the
basement like you have been.
CECE
Sure. Ok.
TREVOR
I know you could be making a
lot more money at a hospital but
I hope you stay.
CECE
Money is not everything. I would
love to stay.
TREVOR
Good. Because I need your help with
the kids if I get them.
CECE
Do you need anything else from me?
Anything.
TREVOR
No. That's all I need.
CECE
Ok. Good.
TREVOR
Can I ask a personal question?
CECE
Sure.
TREVOR
Why don’t you have a boyfriend?
You’re a pretty girl. You have a
nursing degree. You’re a good catch.
CECE
It’s complicated.
TREVOR
Is it because of what happened
to you?
CECE
Kind of.
There is a long pause.
CECE
When I got raped I got an STD.
TREVOR
Oh.
CECE
I have herpes.
TREVOR
I see. So you’re afraid to give
it to someone.
CECE
Exactly. It’s contagious. Once you
have it. You have it for life. You
get outbreaks were it looks like a
blister. I haven’t had an outbreak
in three years.
TREVOR
So you can only get it when you
have an outbreak?
CECE
Correct.
TREVOR
So you’re nervous about giving it
to someone. That's nice of you.
I bet most women wouldn’t even
tell a guy.
CECE
That's not right. So that's why I
don’t have a boyfriend. I was seeing
a guy and he were cool with it. We
just always practiced safe sex.
TREVOR
As long as you wear a condom,
you can’t get it.
CECE
Basically. But you just have to be
careful. They say one out of four
people have it.
TREVOR
So you just have to find a guy with
it and then your set.
CECE
Yes. But all the cute guys don’t have
it.
TREVOR
(Laughing)
Like me.
CECE
Exactly. You’re a ten.
TREVOR
Yeah right. I wish.
CECE
You are. I think you..
The waiter comes to the table.
WAITER
Have you decided what you will
be having?
EXT - BAR - NIGHT
Trevor is dialing number. He hits the end button and dials again. He hits the end button. He looks frustrated. Smoke pulls up in a truck with Jay in the passenger seat. Smoke jumps out and runs up to Trevor picking him up.
SMOKE
Fucking NYPD! I don’t believe it.
You’re a fucking pig. Holy shit!
Don’t search me. I would be your
first arrest.
TREVOR
You’re such an idiot. You better
hope you’re not around my precinct.
SMOKE
Seriously. Congratulations. That's
great. Now you can get the kids.
TREVOR
I hope so.
SMOKE
It’s in the bag. I gotta run.
You going to be here later?
TREVOR
Where you going?
SMOKE
Just gotta do something. I’ll
catch up with you later.
TREVOR
Ok. Cool.
INT - NYPD ACADEMY - DAY.
About two thousand men and women in suits are sitting in a huge
auditorium. On stage there are police officers standing. A chief is standing at the podium.
CHIEF
I want to congratulate you on
appointment to the NYPD. The
finest police department in the
world. This is your first day
as a police officer. From this
day forward you can proudly say
that you are a member of the New
York City Police Department.
Tomorrow you will start the police
academy. Good luck.
EXT – POLICE ACADEMY - DAY
As Trevor is leaving the academy a news reporter comes up to him.
REPORTER
How does it feel to be a member
of the NYPD?
Trevor turns the opposite way and walks away. The news woman runs up to him.
REPORTER
Trevor, can you comment on your
current situation.
Some of the other recruits look puzzled at the reporter. Trevor crosses the street and jogs down the street.
EXT - HOUSE - NIGHT
Trevor and Smoke are walking up the driveway toward the house. The house has no lights on. Trevor puts his key in the door and walks in.
INT - HOUSE - NIGHT
As Trevor and Smoke enter the house. The lights go on.
TINA
Surprise.
Trevor is startled as Smoke laughs. There is a cake on the table that says NYPD on it. Tina runs up to Trevor and hugs him. Trevor smiles. Shelton looks on. Next to Shelton is MS. Taylor. CeCe lights the candles.
SMOKE
That’s Ms. Taylor, the case worker.
TREVOR
Hi Ms. Taylor. How are you?
MS. TAYLOR
Congratulations and good luck next
week.
TREVOR
Thanks.
TREVOR
Shelton. Can you help me blow out
the candles?
TINA
Can I help?
TREVOR
Sure. Come on Shelton, on three.
CECE
One, two,
Tina and Shelton blow out the candles. CeCe smiles.
SHELTON
Can I see my old room?
CECE
Sure.
Shelton and Tina run up the stairs.
TREVOR
What’s going on over at the Foster
house? It doesn’t seem like a safe
place.
MRS. TAYLOR
It was just a random thing.
TREVOR
Maybe the children would be safer
here?
MRS. TAYLOR
Maybe. I wish you luck next week.
TREVOR
We’ll see.
INT - HOUSE - NIGHT
Tina and Shelton are putting on their coats.
MRS. TAYLOR
Thank you for having me.
TREVOR
Thank CeCe. She’s the one who did it.
MRS. TAYLOR
Thank you CeCe. Good luck next
week. I really hope it works
out for you.
Trevor squats down and looks Shelton in the eye.
TREVOR
I love you buddy. I really do.
You mean everything to me.
Hopefully in a week you will
be back in your own house with
your old friends and everything
will be great.
Mrs. Taylor and Shelton exit the house.
TINA
I can’t wait to come back. Don’t
clean my room I left it just the
way I want it to look like when
I come back.
Tina hugs CeCe.
CECE
I love you Tina.
TINA
I love you CeCe.
TINA
Uncle, does your face hurt?
TREVOR
No. Why?
TINA
It’s killing me.
Tina laughs hysterically.
TREVOR
Tina do you know Al?
TINA
No.
TREVOR
Al break your neck.
Trevor laughs.
TINA
Good one Uncle.
Trevor picks up Tina and kisses her all over her face and she is squirming and laughing.
EXT – POLICE ACADEMY, MUSTER DECK - DAY
Trevor is in a group of about thirty men and woman. There are about twenty groups standing and facing a Captain at a podium. The men and woman are dressed in grey police uniforms. Beside each of them is a black bag that says NYPD.
CAPTAIN
Secure your gear, move.
In unison, all the recruits grab their bag.
CAPTAIN
Ground your gear, move.
A man in line shakes his head.
MAN
What a douche.
All at once, the recruits drop their bags.
INT - HOUSE - NIGHT
Trevor walks in the door wearing his grey police uniform. He is carrying his black police bag. He puts the bag on the kitchen table. CeCe come up the basement stairs to the kitchen.
CECE
How was your first day?
Trevor opens the black NYPD bag and takes out a huge folder with papers in it.
TREVOR
I have to know this whole freaking
patrol guide.
CECE
Wow. It looks like a lot of work.
Trevor sits down. He looks exhausted.
TREVOR
And look at this stupid uniform
and hat. It looks horrible. No
wonder people think cops are tools.
The only thing that looks worse
are the security guards that work
for the MTA at Penn Station.
CECE
I think it looks cute. Men in
uniform are attractive.
TREVOR
Not recruit gray uniforms. I can’t
believe I have to wear this.
CECE
My old job was worse. You should
see what I had to wear.
TREVOR
Let me see. I bet it’s no way near
as ugly as this thing.
CECE
Want to bet?
TREVOR
What was it a fast food uniform or
Something?
CECE
How about this, I’ll wear it tomorrow
when you come home. I’ll have it on
as you walk in.
TREVOR
OK. I’m sure it’s not that bad. How
bad can it be? What is it?
CECE
I’ll have it on tomorrow.
TREVOR
Is it a nurse outfit or Kentucky Fried
Chicken uniform? You said your first
job was at KFC.
CECE
It was, but put it this way. Some
people loved my uniform but I
think it was a little embarrassing.
The job required different uniforms.
TREVOR
OK, whatever.
TREVOR
Well I’m beat. I’m going to take a
shower and then hit the books.
See you and your uniform tomorrow.
Trevor walks up the stairs. CeCe watches him go up stairs.
EXT - STREET - NIGHT
Trevor and Smoke are talking on the street. Trevor is still in his police academy uniform. Smoke has a black eye.
TREVOR
How many guys?
SMOKE
A few. I didn’t even see it coming.
They just swarmed me.
TREVOR
Damn, you got fucked up. Those
girls must have been tough.
SMOKE
I wish.
TREVOR
Do you want to file a report?
Trevor laughs.
TREVOR
What have you been up to lately?
I haven’t seen you around.
SMOKE
You know a little of this, a little
of that.
TREVOR
I don’t even want to know. I’m
sure it’s fucked up whatever it
is.
SMOKE
More than you know.
Smoke laughs.
SMOKE
What are you doing now? You want
to get something to eat. I’ll
treat you to Taco Bell.
Smoke pulls out a wad of cash.
TREVOR
Damn son. How did you get all
that money. I don’t even want
to know. I kind of have to get home.
SMOKE
One taco. I know you love Taco Bell.
TREVOR
True. Ok. Lets go.
INT - HOUSE - DAY
CeCe is in the kitchen looking out the window. She has a raincoat over her clothes. Her hair is in a bun.
INT - BAR - Night
Trevor and Smoke are having a drink at the bar.
SMOKE
Have a real drink. Enough with
the sprite. Pigs are allowed
to drink.
Trevor gets up and takes off his silver chain.
TREVOR
Ok. This is how we learn.
Trevor grabs Smoke is a front face lock.
TREVOR
This is how we lean.
SMOKE
Watch the eye. It’s already
fucked up.
Trevor lets him go.
SMOKE
Give me a shot for my pain.
Trevor punches him hard in the arm.
SMOKE
I meant a shot to drink dummy.
TREVOR
Oh my bad. Did I hurt you?
SMOKE
You’re lucky I don’t beat up pigs.
Trevor motions like he’s going to hit him.
TREVOR
This is how we learn.
INT - HOUSE - Night
CeCe is still in the kitchen looking out the window. She sees Trevor. She quickly pours a shot of vodka and swallows it.
EXT - DRIVEWAY - NIGHT
Trevor is walking up the driveway. He opens the door.
INT - HOUSE - NIGHT
Trevor puts his book bag on the table. CeCe enters the room.
TREVOR
Hey CeCe. What’s with the
raincoat? What are you a flasher?
CECE
You said you wanted to see my
old uniform.
TREVOR
Yeah. Where is it?
CECE
This is kind of embarrassing.
TREVOR
Welcome to my world.
CECE
Ok. Go in the living room.
Trevor laughs.
TREVOR
OK. You’re not going to bust out a
bucket of chicken with two sides,
mashed potatoes and corn with a
KFC hat. Are you?
Trevor walks into the living room. CeCe pours another shot and drinks it.
INT - LIVING ROOM - NIGHT.
Trevor is standing in the living looking at the television. CeCe walks in. She faces Trevor. She takes her bun out of her hair and her hair flows down her shoulders. She takes the raincoat off. Trevor’s eyes light up. Under the raincoat CeCe has a lingerie outfit on. It is a black bustier with black stockings and a white thong. She turns around as Trevor’s eyes are fixated on her body.
TREVOR
Holy shit.
CeCe
I use to be a stripper.
TREVOR
Wow. You’re not as innocent as
I thought.
CeCe steps toward Trevor and they are now face to face. CeCe puts her hand behind Trevor’s head and starts kissing him. She then turns her body around and grinds her body on Trevor as she turns her head to make out with him. CeCe turns around and starts to undress Trevor. His veins are popping out of his arms as she takes his clothes off. CeCe takes a condom out of her raincoat and opens it. Trevor puts it on and bends her over the couch. Trevor then faces CeCe and picks her up. Her legs are wrapped around him as she is in the air.
INT - LIVING ROOM - NIGHT
Trevor and CeCe are laying on the couch covered by a blanket. Their clothes are all over the living room.
TREVOR
A stripper, huh. How long did
you do that for? Was it good money?
CECE
It was good but I hated it. The
drinking, the drugs. I was
young and stupid.
TREVOR
I know about being young and stupid.
Did you having your situation have
anything to do with stripping.
CeCe takes a deep breath.
CECE
Yes. I was stripping at a bachelor
party, got drunk and then it happened.
TREVOR
And you were afraid that no one would
believe you?
CECE
That too. But I was also afraid about
what people would say. My family
and friends. My parents are Jehovah
Witnesses and I was raised Jehovah.
I was already like the rebel in the
family. But they didn’t know I stripped.
TREVOR
Do you still talk to your parents?
CECE
Not really. They are so pro Jehovah
that they don’t really want anything
to do with me.
TREVOR
You serious?
CECE
In Jehovah Witness, religion comes
first even before family.
TREVOR
What, that’s crazy. So if you
called your parents they wouldn’t
talk to you.
CECE
They would talk but it would be very
generic. Nothing of importance.
TREVOR
That's messed up. How could they put
religion over their own kids.
CECE
We couldn’t even play sports if it
interfered with religion.
TREVOR
Oh my God. What a disaster.
CECE
It was hard growing up?
TREVOR
I’m sorry. That’s so messed up.
One day I’ll tell you about my
childhood. It’s worst than yours.
CECE
Can I ask you something?
TREVOR
Sure.
CECE
Did you murder those guys or
were you innocent?
TREVOR
That's an even longer story. If
I get the kids back and they
graduate college, I’ll tell you.
It’s only twenty years away.
CeCe smiles.
INT - HOUSE - Morning.
Trevor is putting on a tie. He is dressed in a suit and his hair is slicked back. He looks at himself in the mirror. He takes a deep breath. CeCe walks behind Trevor. She has a black dress on with her hair in a bun. He gets startled.
CECE
You look very handsome.
TREVOR
Thanks. So do you.
CECE
Are you nervous?
TREVOR
Yeah.
CeCe standing behind Trevor kisses him on the cheek.
INT - COURTROOM - DAY
Trevor is sitting at the table with his lawyer, Paul. CeCe is sitting with Tina and Shelton. Behind them are Mr. and Mrs. Foster along with their case worker. Across from them is the State social service woman, MS. JONES. At the front of the courtroom is a five panel administration, consisting of three men and two women. The ruling judge walks toward the bench from his chambers. Everyone gets up.
JUDGE
Please be seated. Ms. Jones
proceed.
INT - COURTROOM - DAY
Ms. Jones is talking to the panel pointing at Trevor. She takes out a newspaper clipping and shows it to the panel.
INT - COURTROOM - DAY
Paul gets up to address the panel.
PAUL
Some of what Ms. Jones has said
is true. Some. Not all. Yes
Mr. O’Brien did kill three people.
But he did it saving a woman’s life.
He did it in self defense. He was
never convicted. Wrongfully served
eleven months. Sued the city and
won. He was wrongfully imprisoned
for eleven months. His record is
clean. Never convicted of a crime.
He’s as innocent as you or I.
Remember, he saved a woman’s life
and risked his own to do it.
MS. JONES
A woman who was never found.
PAUL
(Loudly)
Excuse me. Do you have some hidden
agenda? This is about custody
of three children. For the record
there was blood and hair evidence
at the scene. Clearly the woman
was too embarrassed to come forward
and I don’t blame her. She left
enough of herself on the stairway
that day. And Mr. O’Brien saved
her life. Mr. O’Brien is a hero.
JUDGE
That whole situation is suspect. However,
lets just stick to the matter at hand.
Mr. O’Brien is here for custody
hearing, lets keep it that way.
Ok, MS. Jones. And Mr. Marcelli you
will lower your voice and not raise
it to try to intimidate this court.
I will not tolerate it and I will
have you thrown out of this court.
MS. JONES
Mr. O’Brien has no parenting skills.
No wife. The children are much better
off in a stable home environment with
a mother and father. Mr. O’Brien may
be a great person but we have to do
what’s best for the children. The
most important thing is the children’s
well being.
JUDGE
I agree. We are here to do what best
for the children.
PAUL
Your honor, we all want that. There
are millions of single parents
who do a wonderful job.
JUDGE
Excuse me. I’m not finished. Do
not interrupt me again.
The panelists all shake their head.
INT - COURTROOM - DAY
Ms. Jones continues to speak and the panel seems to be agreeing with her.
INT - COURTROOM - DAY
The court is empty except for the 5 people on the panel.
PANEL 1
I agree with Ms. Jones.
PANEL 2
Me too.
PANEL 3
I’m with Mr. O’Brien.
PANEL 4
Ms. Jones is right. The children
need to be in a healthy environment.
PANEL 5
Mr. O’Brien does show some good
qualities. I’m undecided.
INT - COURT ROOM - DAY
PAUL
Aside from Mr. O’Brien saving a
woman’s life, he also served his
country honorable in the United
States Marine Core.
MS.JONES
Judge, could you have Mr. O’Brien
roll up his sleeves.
PAUL
What does that have to do with
anything?
MS.JONES
Judge.
JUDGE
I don’t see the relevance in that
but Mr. O’Brien please roll up
your sleeves.
Trevor rolls up his sleeves revealing his tattooed covered arms.
PAUL
Yes Mr. O’Brien has many tattoos or
as I like to call it art. Art is a
show of expression. And I’d like
to point out one particular tattoo
of the United States Marine core.
JUDGE
Ms. Jones I don’t see the relevance
of the tattoos. I also served in
the United States Marine Core and
have a tattoo of the core on my body.
Lets move on.
Trevor locks eyes with the judge.
TREVOR
(coughing)
Hooh Rah.
The Judge smirks.
JUDGE
(coughing)
Hooh Rah. Excuse me.
Paul looks at Trevor then at the Judge. He has a smirk on his face.
PAUL
Judge. Let me also add that Mr.
O’Brien was awarded many medals
for his bravery in countless
missions. In addition he was a
squad leader. As we know serving
in the military is serious business.
It takes a special person to serve
your country and risk your life.
Putting your life on the line so
others can have a better life.
There is no better quality. The
bond that all soldiers share when
they served together should never
be forgotten. Soldiers protecting
soldiers is the same as Uncle
protecting nieces and nephews.
MS. JONES
Just because Mr. O’Brien served in
the military doesn't make him a
good parent. What does that have
to do with anything? It doesn’t make
him a good parent.
JUDGE
Ms. Jones. The Military prepares you
for many aspects of life. I can
attest to that.
PAUL
Your Honor, May I also add that Mr.
O’Brien is a member of the NYPD.
He is a NYPD officer.
MS. JONES
He is in the academy.
PAUL
He is being paid and was sworn in
last week. That makes him a NYPD
officer. He is allowed and expected
to take police action. If something
happened in this room, Mr. O’Brien
has the authority and responsibility
to take action. Mr. O’Brien has been
helping people his whole life.
Society won’t allow a man to raise
his own flesh and blood but we expect
him to protect our country, protect
our streets and protect a woman from
being raped. It makes no sense to me.
JUDGE
Ms. Jones. Do you have anything else
to add?
MS. JONES
I strongly believe that the children
need a stable two-parent house.
The children would have a chance at
a new life with a fresh start.
JUDGE
Mr. Marcelli, anything else?
PAUL
I would also like to add that Mr.
O’Brien will be keeping the same
live in nanny that has lived with
Mr. O’Brien’s sister and husband
prior to their death. Thank You.
INT - COURTROOM - DAY
The court is empty except for the Judge and the panel.
JUDGE
Well what do you think?
PANEL 1
We are still three to one against.
JUDGE
This is a tough one. You have a
twenty eight year old man who has a
lifetime of experience, who is willing
to basically give up his life to
raise three children. I feel he
is fit but majority rules and I
rarely over rule a majority, so lets
do this by the book. Lets get your
documents ready now so when they come
back from lunch we can proceed.
INT - COURTROOM - DAY
Trevor is sitting with Paul. On the other side is Ms. Jones. The Judge is sitting behind the bench. The panel is sitting under the judge. They all have a piece of paper in front of them. The judge stands up
JUDGE

CECE
That's great.
Trevor walks in the door.
CECE
Did you hear that Shelton won the
dodge ball game?
TREVOR
No. He didn’t tell me.
Shelton walks to his room.
TREVOR
He’s still not responsive.
CECE
Give him time. He will come around.
TREVOR
I have to get ready. Six to Two

TREVOR

been doing?
SMOKE
Mixed up with some shit.
TREVOR
Bad shit.
SMOKE
Nothing I can’t handle. Always with a
Z into something.
TREVOR
Yeah. You’re a cat with nine lives.
EXT - STREET - NIGHT
In a parked car are two Hispanic men. They have guns in their laps.
HISPANIC 1
As soon as they pull off we get
him.
HISPANIC 2
What about the other guy?
HISPANIC 1
If he’s in the car, he goes too.
EXT - STREET - NIGHT
Smoke gets into his car. Trevor gets in the passenger seat. Smoke starts the car up.
TREVOR
Shit. I forgot my wallet.
Trevor walks back in the pizzeria and then exits with his wallet. An older Woman, MRS. CLAY, stops him.
MRS. CLAY
Trevor O’Brien. How are you?
TREVOR
Mrs. Clay, how are you?
MRS. CLAY
Great. I’m so proud of you. You
really changed your life around.
A police officer. That’s great.
While you are here could just help
me with something upstairs.
TREVOR
Sure. Hey Smoke, I’ll walk home. I
have to do something.
MRS. CLAY
No, no. I didn’t know you were busy.
TREVOR
No. It’s Ok. Smoke, I’ll see you later.
Smoke pulls away.
MRS. CLAY
Thank you so much.
EXT - KIM’S APARTMENT - NIGHT
Trevor is parked across the street in his truck looking at Kim’s building. A car pulls up across the street. Steve and Kim walk to her building holding hands. Trevor stares at them.
INT - POLICE ACADEMY - DAY

INT - HOUSE - DAY

INT - CAR - NIGHT
Smoke is driving his car and stops at a light. A black Mercedes pulls up next to him. The light turns green and Smoke drives away. The Mercedes follows Smoke. The car pulls beside Smoke as he is driving. The tinted window rolls down in the Mercedes and a man starts firing. Smoke turns his car into the Mercedes. They crash into each other. Smokes fires his gun into the car as the man in the Mercedes fires back.
SMOKE
(Yelling)
Come on motherfuckers.
Bullets are flying everywhere. Smoke turns into a self storage parking lot. The Mercedes runs into Smoke and both cars go crashing into a wall. Smoke is bleeding from his head and blood is coming out from his neck. He puts his hand on his neck to cover the bleeding. He falls out of his car. The two Hispanic men are still in their car. The driver is conscious and trying to move. The other man opens the door and falls out of the car. Smoke hobbles over to him and puts the gun to his head. Smoke pulls the trigger. The man fall back to the ground. Smoke puts the gun to back of the man’s head and pulls the trigger again. With one hand, Smoke unloads the magazine and pulls another from his pocket and reloads it. He walks over to the man in the Mercedes. He unloads his gun as the man barely moves. He takes his hand off his neck and blood pours out like a facet. He hears police sirens. He falls to the ground as the blood continues to flow. He sits against a wall.
SMOKE
Nobody kills Smoke except Smoke.
Smoke puts the gun to his head. He then sees the man on the floor moving. At the beginning of the parking lot, he sees the police cars. He quickly crawls to the man on the floor and put the gun in his eye and pulls the trigger. The police cars come to a halt in front of Smoke.
POLICE
Put the gun down.
Smokes gets to his knees.
POLICE
Drop the gun.
SMOKE
Watch this.
Smoke puts the gun to his head. CLICK. No bullet comes out.
INT - HOUSE - DAY
Tina and Shelton are playing WII games. Trevor is sitting on the couch watching them.
TREVOR
Saturday night. What do you guys
want to do tonight?
TINA
Movies, ice cream, hide and seek,
and cookies.
TREVOR
Wow. That's a lot. What about
you Shelton?
Shelton doesn’t answer.
TREVOR
Shelton. What do you want do tonight.
SHELTON
I don’t care.
TREVOR
So you don’t want any ice cream or
cookies tonight.
TINA
Shelton.
TREVOR
Tina give us a minute. I want to talk
to Shelton alone.
Tina leaves the room. Trevor sits down beside Shelton. Shelton doesn’t look at him and continues playing the WII games.
TREVOR
Shelton. What’s wrong?
Trevor takes the controller from his hand. Shelton tries to get up but Trevor grabs his arm.
TREVOR
Shelton. You have to help me out
here. What’s the problem. Do you
not like it here? Do you not like
me? You have to tell me so I can
help you be happier.
Shelton looks away. Trevor gently puts his face on the side of Shelton’s head.
TREVOR
Shelton, you’re my nephew and I love
you a lot. You have to tell me what
the problem is. Please.
The Phone rings.
TREVOR
Do you not like me? Would you rather
live somewhere else?
Shelton starts to cry.
TREVOR
It’s Ok. It’s OK.
TINA
Uncle. The phone is for you.
TREVOR
Not now. Take a message.
TINA
It’s the police.
Trevor picks up the phone.
TREVOR
Yeah, this is him... How...When...
OK, I’ll be right there.
Trevor hangs up the phone. He walks back to Shelton.
TREVOR
(Angry)
What's your favorite toy that you
don’t already have.
Shelton doesn’t answer.
TREVOR
I said what’s your favorite toy?
If you could have any toy what
would it be.
Shelton doesn’t answer.
TREVOR
(Angry)
Answer me boy. Now.

TREVOR

SMOKE
You should see the other guys.
They’re in the morgue section

CECE
I’m sorry.
Trevor shakes his head.
CECE
We never spoke about what happened
between us.
TREVOR
I’m just too exhausted right now.
Maybe it was a mistake. We
probably shouldn’t have done
it. Right or no?
CECE
I just want to know what you think.
TREVOR

Trevor hands him the Ironman.
SHELTON
Wow. Awesome.
Shelton puts his hand on Trevor’s shoulder.
SHELTON
Why don’t you keep it? You can
have it.
Trevor smiles.
TREVOR

for you.
Trevor lays down on the bed as Shelton opens it.
SHELTON

I really hate this job. It really
sucks. I can’t wait for the FDNY
test.
TREVOR
Yeah. Why.
ADAM
FDNY is a great job. No bullshit
like we deal with. Everybody
loves fireman. The public hates
us and love firemen. They make
the same money as us but with
no headaches.
TREVOR
I heard court officer is good too.
ADAM
Yeah. That is good. Also Port
Authority police test is coming up.
TREVOR
They make good money?
ADAM
Way more than us. And also MTA is
having a test.
TREVOR
Isn’t that transit?
ADAM
That's what people think. You
know how we have NYPD transit,
we do all the subways. These MTA
faggots do just the LIRR and
Metro North. I have a friend Bert,
who is a MTA cop. He told me he
makes way over a hundred grand and
they’re all pussies. They don’t do
shit. They take rollovers, guys
who were NYPD. This way they don’t
have to retrain them. They just
roll over onto that job.
TREVOR
Get me that application when it comes
out.
INT - CAR - NIGHT
Trevor is driving at night when his cell phone beeps. He looks at his phone and smiles. He speeds up the car and seems to be rushing home.

TREVOR
Please discontinue all communication,
stop contacting me. I want all
communication to cease meaning:
phone calls, emails, and texting
via phone, commuter parking lot,
my home, as well as you coming to
my job. It’s been almost a year and
you still cannot move on. This is
harassment, I stated this to you in
the past. I will get a restraining
order against you or an order of
protection and you will lose your
niece and nephews. Please see counseling
to help whatever troubles you have.
I have moved on and I am very happy.
Trevor gets up and hurries to his bed room. He opens his closet and takes out a bullet proof vest out and puts it on. He takes out a gun from a shoe box on the top of his closet. He puts it in an ankle holster and puts it on his ankle. Shelton is standing by the door watching while holding his ironman figure.
SHELTON
What are you doing uncle?
TREVOR
Nothing. Go to bed.
SHELTON
Where are you going?
TREVOR
(Angry)
I said go to bed.
SHELTON
But where are you going?
TREVOR
Go to your fucking room.
Shelton starts to cry.
SHELTON
You said you would never leave us.
Trevor takes another gun and puts it in waist. He takes two small knives in a sheave and straps them to his other ankle.
TREVOR
I said go to fuckin bed.
CeCe enters the bedroom.
CECE
Trevor. What’s going on?
TREVOR
Nothing. Put him to bed. I’ll
be back later. I have to take

STEVE
Don't do it. Don’t throw your
life away.
TREVOR
It’s too late now. My life is
over. The only reason you’re dying
is to make that bitch pay.
Trevor fires five rounds into Steve. Trevor walks to the bedroom.
TREVOR
I know you’re calling the police.
I don’t give a fuck.
Trevor kicks in the door and enters the room.
TREVOR
(OS)
You had to be a cunt. You had
to send me that stupid e-mail.
You had to push me.
KIM
I was scared. It was the only way
to get you to stop.
TREVOR
I fuckin loved you so much, I needed
you and you let me fuckin down. How
could you be such a bitch.
The sounds of sirens are getting louder and louder.
KIM
The police are here. Please leave.
Just don’t kill me.
As Kim curls in the corner Trevor sits on the bed and looks around.
TREVOR
I always liked this room.
Trevor continues to look around.
KIM
Please.
TREVOR
Shut the fuck up bitch. You’re
the reason I’m in this mess.
Trevor looks down and takes a deep breathe.
TREVOR
You put me through so much.
Fuck you.
Trevor gets up and fires three rounds into her. He walks over to her and fires a point blank round into her head. Trevor can hear the police entering the apartment.
TREVOR
Ok. Time to party.
Trevor drops the magazine out of his gun and puts another magazine in. He takes the gun on his ankle and puts it in his other hand. He points both guns at the door.

INT - HOUSE - NIGHT
CeCe is standing in the living room. Trevor walks over to her.
CECE
I read the e-mail. Trevor I think
I should move out. This is not
working. This is way too much
for me.
Trevor kisses her and then hugs her.
TREVOR
Just give me a minute. Ok. Just
wait here for five minutes, OK.
CECE
Ok.
Trevor walks up the stairs.
INT – SHELTON’S ROOM - NIGHT

TREVOR
That was perfect.
Shelton looks up.
TREVOR
That was excellent. Good job. How
did I do? Did it seem real?
SHELTON
What are you talking about?
TREVOR
That was an act I was doing.
The police department is putting
me in a movie and that was my
scene. They told me to go home
and try it and see how my family
would react. I was playing the
bad guy. Was I good, did I have
you fooled. Remember a few weeks
ago I told you I was going to be in
a movie and I had to act some
scenes out. Remember.
SHELTON
I don’t remember.
TREVOR
You where kind of half asleep, it
was a few weeks ago. You remember.
Trevor laughs. Shelton smiles a little.
SHELTON
I thought you were leaving
us to kill someone.
Trevor laughs.
TREVOR
I was that good. Awesome. Did
I really have you fooled?
SHELTON
Yes. I was scared but why did you
yell at me and curse at me.
Trevor laughs.
TREVOR
I had to because in the movie I
have to yell at the kid. It’s
in the movie.
SHELTON
So it was all an act.
Trevor laughs.
TREVOR
Of course. You’re my best friend,
remember. I would never yell at
you for real. I was acting
SHELTON
That's cool.
TREVOR
Well hopefully I will get the part.
Was I a good actor?
SHELTON
Yes. You tricked me. That would be
awesome if you are in a movie.
TREVOR
Look what I found outside.
Trevor hands him the broken figure.
SHELTON
Well, I didn’t know you were faking.
TREVOR
No problem. We’ll get another one
tomorrow. I’m just glad that I
fooled you. That means I did a
good acting job.
SHELTON
You are a good actor Uncle.
TREVOR
Thanks. I had CeCe fooled too.
Shelton Laughs. Trevor kisses Shelton on the head.
TREVOR
I’ll see you in the morning.
Trevor exist the room and closes the door. He see’s Tina in the hallway.
TINA
Good acting job Uncle.
TREVOR
Thanks, not bad, huh. I hope I
get the part in the movie.
TINA

Shelton’s room.
Trevor looks at Tina and smiles.
TINA
I love you uncle. Good night.
Tina walks into her room. Trevor watches her walk in her room.
INT - HOUSE - NIGHT
CeCe is sitting on the couch. Trevor walks to her carrying a black garbage bag.
CECE
Trevor. I’m sorry. I just can’t
do this. I think you still have
a lot of issues with your ex.
I can’t have these feelings for
you if you have feelings for her.
I have to move.

That part of my life is over.

Yeah. I’ve never be so sure in my life.
Trevor smiles. CeCe cries. CeCe grabs Trevor and they kiss as the flame rises. Tina looks out her window smiling.
